Please can you provide me with the following information under the
Freedom Of Information Act 2000:-

(a) addresses of residential properties that are within the borough
that are "non-individually owned property"

(b) the names of the owners of the companies referred to in and
their correspondence address

If the council will not release this information, I would like the
names of all "non individuals" (business, charities, trusts etc),
but excluding housing associations and the council, that own
residential property in the borough, without addresses.

For your information, the Act defines a number of exemptions which may
prevent release of the information you have requested. There will be an
assessment and if any of the exemption categories apply then it will not
be released. You will be informed if this is the case.

whether or not to release the information to you.

In some cases there may a fee payable for the information requested. This

Re: Freedom of Information Act 2000 and Environmental Information
Regulations 2004 - Refusal Notice

Your request for information, received on 1 September 2015, has now been
considered.

We can confirm that the information you requested is held by the London
Borough of Camden. We are, however, advising you that such information is
exempt under the terms of the Freedom of Information Act 2000.

Section 17 of the Freedom of Information Act 2000 requires us, when
refusing to provide such information, to provide the applicant with a
notice which: (a) states that fact, (b) specifies the exemption in
question and (c) states (if that would not otherwise be apparent) why the
exemption applies.

Where the application of statutory exemptions involves the application of
the public interest test section 17 of the Freedom of Information Act 2000
requires us to state the reasons for claiming that, in all the
circumstances of the case, the public interest in maintaining the
exemption outweighs the public interest in disclosing the information.

Please find enclosed the statutory exemptions applicable to your request
and, where applicable, a summary of the reason(s) why they have been
applied.

Response:

It is going to take longer than 18 hours to provide the information for
this request, the Freedom of information Act 2000 allows us to refuse the
request on the grounds of cost.  The Regulations allow a public authority
to charge the following activities at a flat rate of £25 per hour of staff
time:

The Act allows us to take account of the cost for:-

o determining whether it holds the information requested,
o locating the information or documents containing the information,
o retrieving such information or documents, and
o extracting the information from the document containing it

The Team estimate that to answer your request they would have to nominate
a member of staff to trawl through 106,600, extract and collate the
information and cross reference the results with several colleagues to
ensure accuracy and that all personal data etc. has not been included

Time: circa 36 hours

           Total cost = £900.00

Section 16 places a duty on authorities to help an applicant refine their
request so that it can be answered in the appropriate limits. Please bear

Team providing the data and, in the first instance, refuse your request
for an internal review. Firstly, because our response was sent on 23^rd
September and your request for a review is dated 31^st December 2015,
which is more than two months later. Please see below which was contained
in our response to you.

However, we are also of the opinion that you do have the right to

I have discussed this with the team providing the data and have the
following additional response for you

S12, exceeds appropriate limits, was applied because it involved an
exercise of filtering a list of 106,600 properties in order to supply your
information.

However, in relation to your refined request, the team have said that
Council Tax records do not record ownership, our records the liable party,
who may not necessarily be the owner.

More importantly, in terms of names and correspondence addresses of
owners, I will log the refined request contained in your review request
and resend to the team for them to consider providing the data to you.
Please let me know if this is acceptable to you. You should receive an
acknowledgement shortly
