Dear City of York Council,

1. Please provide me with the contract(S) , service level agreement and all performance metrics for each of the last 3 years.

2. Please provide a schedule of all billings in each of the last three years.

3. Please confirm if the Occupational Health contracts have ever been the subject of any internal audits - if so please say when and provide them.

4. Regarding the recent failure of the occupational health service to respond to the request to Mary Weastell ( as highlighted in Mazars Public Interest Report) please provide a schedule of all the dates the HR team contacted the OH team to expedite the service which we are told did not happen until 7 January 2019.

5. Please provide a schedule of all management actions by the Head of HR, Monitoring Officer and CX/COO between May 2019 and January 2020.

Please provide information in reusable form ideally Exel as per ICO guidance.

I simply cannot follow your confusing reply so please start again.

1. Please will you provide the exact links to all those instructions rather than list long sets of instructions which people can’t follow. It would have been quicker for you to do that too.

2. Since I have no idea who the contractors are, even if I could navigate the system I can do nothing hence my request for the exact links.

3. Re 6 and 7 - I had hoped I was clear - 6 was related to all the HR contacts 7 all management actions regarding the matter .. eg CX, Statutory Officer involvements even members to address this delay.

When you have provided me with proper links and details I will be happy to respond if there is a shortfall.

In view of the seriousness of this farrago, please Just be helpful-many members will need this too. Posting a link which you will have to have navigated seems little effort in view of the gravity of the situation.

I have now completed a review of how the council has dealt with your
request under the Freedom of Information Act (FOIA).

 

I apologise for the delay in responding to your original request and I can
advise all information had been provided by managers for the response and
the delay was due to an oversight in sending the response to you.

 

I can now provide the following response to your request.

1.   Please provide me with the Occupational Health contract(S) for each
of the last 3 years.

Some information has been withheld under section 43 of the FOIA, because
it is considered to be commercially sensitive. This is because it is
considered to break information down in a way which would provide other
companies with a commercial advantage and would put the council at a
commercial disadvantage in future contracts.

 

The council understands the strong public interest in the public being
able to understand how public funds are being spent and hold the council
accountable for ensuring appropriate value for money services are
provided. The council also recognises there is a strong public interest
issue associated with this contract, relating to matters linked to the
recent auditor’s Public Interest Report. The council however considers the
information to satisfy this is being provided in this response and in
information already publicly available.

 

The council also considers there is a strong public interest in protecting
the public purse in future contracts and for companies to be able to
compete for contracts without unfair disadvantage.

 

Having considered the issues above the council has concluded the weight of
public interest is in maintaining the exemption.
