Occupancy for the 19/20 teaching year

The request was refused by Education and Skills Funding Agency.

Dear Education and Skills Funding Agency,

I would like to request the total number counted as in learning for the teaching year 1st August 2019 to 31th July 2020, by institution and then by qualification. This should be not only starts for the year in question, but contain all carry in learners from the previous year. So it should be the total starts and carry in learners for the year in question. Where the provision is delivered by a subcontractor, I would like to know the name and UKPRN of that subcontractor.

I would like to have this broken down in excel format, in a table, with the following information per row:

Name of Subcontractor Institution
Subcontract Institution UKPRN
Qualification Aim Reference
Qualification Aim Title

In a follow up request also on 21/10/2020, you requested additional
information to this request asking:
 
“Could I further ask, would you be able to break this down so that the
provider type is displayed, for example:  FE College, Sixth Form College,
Private Provider.   I would expect to see a table in the following style
as a result:
 
MIS Software Name,FECollege, SixthForm College,Private Provider, Total MIS
Software 1,10,10,10,30 MIS Software 2, 1,1,1,3”
 
 
I have dealt with your request under the Freedom of Information Act 2000.
 
 
 
The Department holds the information you have requested relating to
further education learner participation/aim enrolments in the 2019/20
academic year, but it is being withheld because an exemption under Section
22 of the Act applies. Section 22 provides for information to be exempt
from disclosure where the information is held by the Department with a
view to its publication by the Department or any other person at some
future date. It was so held at the time your request was made, and it is
reasonable in all the circumstances that the information should be
withheld until that date.
 
Section 22 of the Act is a qualified exemption which means that a public
interest test needs to be carried out, and in doing so the following
factors have been considered:
 

* It is acknowledged that there is a general public interest in
disclosure because of the need for there to be open and transparent
government and that the sharing of information with the public should
be free and open. 
* However, the public interest in permitting the Government to publish
information in a manner and at a time of its own choosing is also
important.  It is part of the effective conduct of public affairs that
the general publication of information is a conveniently planned and
managed activity within the reasonable control of the public
authority. 

The Government has already determined that it will publish such
information in due course. This data will be released alongside the
‘Further education and skills: November 2020’ statistics publication.
It is not reasonable for the Government to be expected to release
piecemeal information in advance of its planned timetable and there is a
strong argument in favour of allowing everyone to view this information at
the same time. The arguments for and against release have been considered
and it is our view that the balance of public interest falls in favour of
the maintenance of this exemption in relation to the information relating
to this request.
 
In addition, further education learner participation/aim enrolments in the
2019/20 academic year will be national statistics published alongside the
Further education and skills: November 2020 statistics publication. To
release now would pre-empt the publication schedule. Therefore, we are
withholding this information at this time under an exemption at section
44(1)(a) (Prohibition on disclosure) of the Act.
 
The Department is not obliged to provide information if there are
prohibitions on disclosure ‘by or under any enactment’ (Section 44(1)(a)
of the Act). further education learner participation/aim enrolments in the
2019/20 academic year will be published in the ‘Further education and
skills: November 2020’ publication. Release of these figures are
prohibited by s.11 and 13 of the Statistics and Registration Services Act
2007 and the Pre-release Access to Official Statistics Order 2008.
 
The Department for Education is obliged under Protocol 2 of the SRS Act to
ensure that no indication of the substance of a statistical report is made
public, or given to the media or any other party not recorded as eligible
for access prior to publication. I can confirm that the Department for
Education does publish this information as part of their Official
Statistics. To pre-release now would breach s.11 and therefore engages the
exemption under Section 44(1)(a).
 
Section 44(1)(a) of the Act is an absolute exemption and does not require
a public interest test.
 
Subcontracting breakdowns will not be published in the Further education
and skills: November 2020 statistics publication. Given these are further
breakdowns of the overall participation/enrolments figures these cannot be
provided as they will pre-empt the headline figures in the statistics
release. Once the Further education and skills: November 2020 statistics
publication is published please can you resubmit your request updating
your requirements based on the published material.

44 to our previous response. Could you please state how this differs from
this and if so, can you make it clearer how we can fulfil your request.
