ScarletPimpernel made this Freedom of Information request to Wirral Metropolitan Borough Council

Automatic anti-spam measures are in place for this older request. Please let us know if a further response is expected or if you are having trouble responding.

The request was partially successful.

Dear Wirral Metropolitan Borough Council,

I'd like to make an Environmental Information Regulations 2004 request for all objections received by post (or by email) by Wirral Council during a consultation period that ended today at noon (8th January 2020). The consultation was asking for objections to the disposal of land by Wirral Council off Arrowe Park Road, Upton and also for objections for its use for retail development and ancillary uses. Wirral Council's reference for the consultation was PAR/LHRAM/33687 and objections were requested to be e-mailed to [email address] or by post to Director of Law and Governance, Wirral Borough Council, Distribution Services, 5 Sandford Street, Birkenhead, CH41 1BN.

With regards to the form and format of the information (regulation 6) I am requesting that it is provided electronically in .pdf format (Adobe Acrobat). I would also prefer each individual objection to be sent as a separate file, as this will provide clarity as to which objection is referred to in case there is any subsequent challenge made to any redactions you may have made to objection/s.

I remind you of your duty under reg. 9 to provide advice and assistance and look forward to your response within 20 working days.

Yours faithfully,

John Brace

Wirral Council considers that information amounting personal data is
exempt information, as contained in Regulation 13 EIR 2004.  We consider
that the disclosure of requested information would contravene the Data
Protection Act 2018 because personal data shall be lawful and fairly
processed in relation to individual(s) and we consider that the
individual(s) concerned would have a legitimate expectation that their
personal data would not be further processed.

We trust that you find this information of assistance and concludes your
enquiry.

You have the right to make representations under Regulation 11 of the 2004
EIRs in respect of the refusal to supply information requested, which
should be sent to [1][Wirral Borough Council request email]  .  If you are
dissatisfied with that response to your request, you also you have the
right to complain to the Information Commissioner, but would normally be
expected to make representations to the Council first, before complaining
to the Commissioner at [2]https://ico.org.uk/global/contact-us/

Please also be advised due to current pressures on the Council’s resources
and workforce, due to the Corona Virus; you may experience a delay in
response to any clarification/review/enquiries you submit.
