REQUEST

 

I understand that all of your personnel swear an oath of allegiance to the
Crown; please can you tell me how many cases there have been of officers
found in breach of their oath since 2004.

 

CLARIFICATION REQUIRED

 

I am writing to ask you to clarify your request. This is because we need
further details from you in order to identify and locate the information.

 

The Oath is not ‘breachable’, officers are held to account under the
Standards of Professional Behaviour, therefore, I should be grateful if
you would clarify what information you would like us to search for and in
addition are you referring to both Police Officers and Special Constables?

 

Please contact me if you need assistance with this.

 

To enable us to proceed with your request I would be grateful if you could
provide the clarification outlined above within 40 working days of this
correspondence. After receiving your reply, your request will be
considered and you will receive a response within the statutory timescale
of 20 working days, as defined by the Act, subject to the application of
any statutory exemptions. If you choose not to respond then your request
will be closed.

Hi Andrea, thank you for your message. I am interested in any instances where it has been determined that any of your officers or special constables who have sworn an allegiance to the crown - to defend the interests of the king and his successors etc, have failed in this particular obligation. I'm not familiar with the specific oath or attestation that you use and the PSNI, for instance, make no mention of any obligations towards the crown in theirs so it may be that this is not relevant in your case either?

We clarified with you on 27^th June 2024 and 1^st July 2024.

 

You replied:

 

I am interested in any instances where it has been determined that any of
your officers or special constables who have sworn an allegiance to the
crown - to defend the interests of the king and his successors etc, have
failed in this particular obligation. I'm not familiar with the specific
oath or attestation that you use and the PSNI, for instance, make no
mention of any obligations towards the crown in theirs so it may be that
this is not relevant in your case either?

 

 

RESPONSE

 

I am writing to inform you that we have searched our records and the
information you requested is not held by West Midlands Police.

 

The oath is not “breach able”. Police Officers and staff are bound by the
professional standards requirements.

Thank you for your reply which implies that the oath, in not being 'breachable', has no actual relevance to the day to day duties of your staff whose standards of behaviour are judged against the Police Conduct Regulations.
