Numbers of cases stayed due to WV litigation and guidance on applying decision

Dear Department for Work and Pensions,

1. Any internal guidance or instructions your client has issued to Decision Makers or Case Managers about how to deal with cases similar to SSWP v WV (UC) [2023] UKUT 112 (AAC) since judgment in that case was issued on 19/05/2023.

2. Any management statistics or other information showing the number of cases where decision making has been stayed to await the outcome of any appeal to the Court of Appeal.

Please note that we made this request to GLD who are acting for DWP in the WV case on 02/02/2024. On 13/02/2024, GLD lawyer confirmed in an email:

"(i) the DWP is treating Martin’s email as an FOI request received at 18:31 on 2 February 2024;
(ii) the DWP intends to respond promptly and in any event by 1 March 2024;"

In those circumstacnes we consider the time for responding is 01/03/2024 as GLD received the request as your agent and conveyed to us that you had accepted the request in that manner and would respond appropriately.
