Response:

"1 Current policy is to monitor background gamma radiation levels at
three sites around the city every second month. Seawater and beach
radiation monitoring is not

carried out by the council .

2. Three officers of the Environmental Team are trained to carry out the
monitoring using equipment calibrated in accordance with manufacturer's
instructions (Mini 6-80 instrument.)

3. Gamma (Y) radiation. Every two months. 10 May 2011.

4. Instantaneous results are passed to the Radiological Science and Safety
Service based at the Royal Sussex County Hospital. Gamma radiation
Intensity is monitored. Distribution by virtue of three separate
monitoring locations.

5. Tim Nichols - Head of Environmental Health and Licensing.

6. Cllr Ben Duncan - Cabinet Member for Communities, Equalities & Public
Protection.

7. Advice from the Radiological Science and Safety Service

8, 9, 10. The Council has statutory responsibilities in relation to civil
emergencies that are detailed in the Civil Contingencies Act 2004. This
includes risk assessments, planning and exercising.

We do this by working with the other responders and partners under the
Sussex Resilience Forum. The SRF has plans, to which we contribute, to
respond to 'wide area' events that include CBRN incidents. This includes
obtaining specialist scientific advice and communications with the public.

With regard Dungeness, this falls within the Kent County council area. On
and off site plans are prepared and exercised for this facility led by
Kent County Council. We do not attend these leaving it to East Sussex
County Council to act on our behalf and report back if required.

Decontamination equipment is maintained by the Fire Service and the
Ambulance Service "

Thank You for your reply to my FOI request.
I note that the request has not been fully replied to, in my opinion. Without going to the lengths of a further FOI request, can you confirm, as an addenda, that the Council has a specific Nuiclear emergency plan, (if any) as opposed to a general emergency plan, and if so, could you please supply a copy?

Also, who, or what, is the "Sussex Resilience Forum?. I can find no public trace of this organization. Who runs it, and who is in charge?. Does this addendum require an additional FOI request from me?.

Also, who took the decision to limit the radiation monitoring to land areas of the Borough only, and to doing only gamma radiation monitoring, every 60 days? What scientific advice did they take before making these decisions?

There are no records. The Arboriculture Service aims to replace felled
trees, particularly elms, whenever it is practicable. Changes to site
conditions and surroundings, since the original tree was planted,
sometimes render replacement impracticable.

replaced, as in No:5.

There are no records.

7: The costs of felling, and the costs of replanting, as defined
in No:1, above, of all trees in the Borough.

Please can you tell me of:

(1) The total amount of open spaces of significant size, (e.g.
larger than 0.5 Hectares) not at present used for any purpose, but vacant,
owned or on long term lease by the Council.

To our knowledge we do not currently have any land of this size that would
be classified as not at present used and/or vacant. Whilst public access
may not always be available such land is usually in agricultural use or
important for nature conservation. An audit of all open space has been
undertaken and sites classified based on the typologies suggested in the
Government's Planning Policy Guidance Note 17 (PPG17). This data has been
assessed and the findings provided within two subsequent studies
commissioned by this council. These are titled Brighton & Hove City
Council Open Space, Sport and Recreation Study; 2008 (by PMP) and Open
Space Study Update; 2011 (by JPC). Both are available on the council's
website, the following is a link to all the background studies to the Core

affect. In order to meet the needs of an increasing population within a
city, constrained by the sea and National Park boundary, all existing open
space will be expected to optimise their open space use. The following

(2) The total amount of agricultural land of significant size, but
excluding known and identified city allotments, (above 0.5 hectares) owned
or leased by the Council.

We don't lease any land from third parties. The total agricultural land
owned by the council is 4178.32 hectares.

(3) Provide details of the present use of this land, both vacant and
agricultural, in the form of proper utilization maps. Food production
usage, lack of food production on agricultural land, or non-agricultural
use of such land, where it could be used for agriculture, is required.

We are sorry but, no such map exists. We are under no obligation to
produce one and agricultural land leased to farmers is done so entirely at
their discretion as this is a commercial arrangement. To answer this
question is likely to exceed the maximum time that we are obliged to spend
on such an enquiry

(4) Provide details of the leases of any such land, with respect to
agricultural land, in terms of length of leases, general conditions of
agricultural leases, and size of leased land leases in area.(hectares).

Pursuant to s43(2) we consider that there may be a qualified exemption
available based on commercial interests in that disclosure of the leases
could interfere with our position in a competitive environment by
revealing market sensitive information. We have considered also that this
is likely to prejudice a third party's commercial interest (there is also
the question of where this is personal information on the part of those
who are leasing s40 of the FOI). Having considered the public interest
test we do not believe that revealing this information is likely to assist
transparency of public funds; enhanced scrutiny, ensure public money is
being used effectively. What it might do is make it more difficult when
negotiating any leases. We would welcome any representations that you
might wish to make that there is public benefit in revealing this
information. The basic details of land size under the leases will be
available from the Land Registry and therefore as the information is
available from another source we are not obliged to provide it.

(5) Provide details of any vacant land owned by the Council, or held
on long term lease by the Council, not previously identified or
identified in question one, that is considered to be toxicly contaminated,
or previously used for landfill, or other waste dispersal purposes, and
unusable at present as agricultural land.

The obviously identifiable site which fits your requirements is Sheepcote
Valley. The question of what constitutes toxicity is one that is subject
to ongoing revision and consequently we can't give a definitive answer.
This enquiry is one which can be made under the Environmental Information
Regulations (please see attached leaflet). There will be a charge
attached to this. Please note this will constitute a significant amount
of work and it is suggested that you may wish to narrow the search to
provide the Environmental Health Department specifically with sites you
wish to have information on. As stated above there will be a charge for
this or they may be able to arrange an on site inspection of the requisite
documents.

(6) Provide details of any large agricultural buildings, as
required, on land detailed in questions one to five above

To the best of our knowledge other than the redundant agricultural
buildings at Stanmer, such as the Long Barn and the Tractor Shed all
agricultural buildings on BHCC farm holdings are let as part of the
agricultural agreements. To answer this question is likely to exceed the
maximum time that we are obliged to spend on such an enquiry. It would
require the investigation of every farm to ascertain where there are farm
buildings. In any event please clarify what is meant by large. If
specific requirements are tendered as a definition then the act of having
to measure buildings to see whether they come within that definition would
require, in our view, and taken with the research needed to identify them,
in excess of 2.5 days. If you would clarify what purpose you would
envisage such buildings being used for this may assist.

(7) provide details of the percentage of council owned or leased or
leased out land, which is farmed organically, without use of toxic
chemicals, etc.

To the best of our knowledge the only truly organic land on the BHCC
farmland estate is Home Farm Stanmer, which extends to 4.05% of the total
Council holdings. However the request is confusing because it refers to
organic farming without the use of "toxic chemicals". Another definition
of organic is no use of chemicals.

Asbestos, (If Any,) and if so, of what type.

All of these buildings contain asbestos and are either white,
brown or blue asbestos or a combination of these.

3: The monitoring, if any, that is carried out by the Council for

There is ongoing monitoring of these premises which, within Housing &
Social Inclusion, our partners Mears undertake on our behalf in relation
to asbestos management. This monitoring is in the form of asbestos
surveys.

4: The number of known illnesses, (If any) confirmed as being caused
by exposure of the residents to Asbestos.

There are no known confirmed illnesses to residents as being
caused by exposure to asbestos.

5: What tests and examinations have been done to ensure that any

"1:How many trees does the Council own? It is difficult to answer this
exactly, as we do not hold a complete database and it is a constantly
changing figure as tress grow and die. The Council is in the process of
mapping trees in some areas. We have completed this work for the streets
and for smaller parks, but it is ongoing for the larger wooded areas. As
each tree is mapped it is entered in to a system called Arbitrack. So
far only a proportion of the tress on council land hae been mapped.You can
view on appointment the system yourself at no charge. This will be limited
time durations as officers have other commitments. The system is capable
of printing out details of tree locations on A3 paper - dependant on
the level of detail that you want ( the more detail the more printing will
be required), we can provide printouts at 10 pence per page. This may run
to thousands of sheets of paper - so we would estimate that the costs will
run in to the hundreds of pounds, plus staff time as appropriate. The cost
per sheet is based on government guidance. We can provide a more precise
estimate when you have indicated which route you wish to take.

2:How many of them have cut down and removed or disposed of, since 1990?
Again this information is on the Arbitrack system, however this only goes
back till 2003. The work undertaken is recorded on worksheets which can be
printed out. Again this is likely to run in to thousands of sheets of
paper. Also as not all will be cutting down then this will require an
officer to undertake separation. As above this is likely to require costs
from yourself of hundreds of pounds.

3:What is the proportion of these trees that are hardwood species? Please
define what you mean by hardwood. Most indigenous trees are hardwood. The
current estimate is about 90%. "

"1:If the Council allotment regulations, for the allotment tenants,

are in full compliance with the law on allotments, as set out in

the various allotment legislation by law.

Yes - The most recent 2010 rule review was reviewed by legal services
prior to publication to ensure compliance with UK law.

2:That the allotment sizes available are in full compliance with

the legislation regarding the size of allotment plots for tenants,

as set out in legislation.

Yes you are referred to the relevant legislation and commentary available
as a search on the internet, in which you will see it sets out maximum
sizes. This may also be available in libraries.

3:in particular, the various prohibitions, set out in the allotment

rules of Brighton Council, such as the ban on keeping animals, and

the ban on sheds and greenhouses above a certain size, or the

limitations on pond sizes, are lawful and comply with legislation.

Yes however the question is inaccurate to a degree in that there is no ban
on sheds, but there are restrictions on sizes of built structures. Some of
the requirements are not statute based but rather based on other factors
such as ponds being restricted due to concerns about the safety of small
children. The point being, it is not all about legislation some relates to
good practice and to common law.

4:Where restrictions have been placed on activities of tenants, re

no:3 above, whether or not legal advice was taken as to the

legality of the regulations, especially as to their having

discriminatory effects, on tenants.

5:Regarding the long waiting times for tenants to obtain allotment

tenancies, in excess of seven years, for some sites, whether or not

legal advice was taken that this is a lawful exercise of the

Council's powers and obligations under the relevant allotment

the waiting list timings, is as a consequence of demand versus the
availability. There is to the best of our knowledge no statute or case law
about waiting times.

6:What plans the Council has to increase the amount of allotments

available to local residents, and what plans it has to exercise its

legal powers to obtain hire or purchase of land, to increase the

availability of allotments.

The council continues to increase the availability of allotment plots
through plot splitting.

7:Who is the senior Council official with responsibility for

have 327 easel paintings (approx 25% of the service's 1,300 easel
paintings) are displayed across the RP&M Service and in Brighton and
Hove Town Halls. As all museums do we also lend paintings to other
museums and galleries for temporary exhibitions: five works are
currently on loan. The Service holds and around 20,000 works on paper
which are displayed on rotation in exhibitions and the prints and
drawings gallery at Brighton Museum and Art Gallery.
o The Service's complete collection of easel paintings is illustrated in
the East Sussex volume of the Public Catalogue Foundation's series on
Oil Paintings in Public Ownership

Point 3

o Brighton & Hove has a dedicated Town Art Gallery: Brighton Museum &
Art Gallery opened in 1873, and its top-lit art gallery is one of the
earliest purpose-built municipal picture galleries in the country. The
Museum now has three inter-connecting fine art galleries - with the
exception of the Heyer bequest, these are regularly rotated, with the
Print Gallery often featuring a new display every six months. The
downstairs Twentieth Century Design gallery, and other museum spaces,
also show fine art. Its three large temporary exhibition galleries
also regularly display fine art, such as the current exhibition
Radical Bloomsbury: The art of Duncan Grant and Vanessa Bell,
1905-1925'. Hove Museum & Art Gallery was originally built as a home
for John Oliver Vallance in the late 19thC. In 1926 it was purchased
by Hove Corporation and opened as a public museum in 1927. It too is a
municipal resource dedicated to showing fine art and other
collections.
o At present there are no plans in existence for the development of a
separate art gallery for the municipal art collection. However we are
looking into how we can create more flexible spaces in Brighton Museum
and Art Gallery to facilitate changing displays of material from all
the municipal collections.

Point 4

o Offering opportunities for learning, enjoyment and inspiration have
been the ambitions of the Service since its inception and the
development of Brighton Museum & Art Gallery. In 2010-11 it attracted
209,000 visitors, including almost 7,000 schoolchildren. The Service
runs a full programme of schools sessions and events for early years,
children and families, young people, and adults, across all its sites
(http://www.brighton-hove-rpml.org.uk/Wha...).
Many of these relate specifically to fine art, decorative art and
applied art material, and involve encouraging creative responses to
these collections. We also run school loans, outreach activities and
community engagement projects - as well as our community-based
micro-museums - which take the collections out to local residents in
the city.
o The Service has an acquisitions & disposals policy

and additions to the collections are considered in relation to this
policy. We have just had part-funding confirmed from the Art Fund for
the purchase of a major painting to add to the collections.
o We actively take up opportunities to build our knowledge and
understanding of the municipal art collection, benefiting from - for
example - the National Inventory Research Project (NIRP) and the
National Gallery's Neil MacGregor Scholarship scheme, major awards
from the Arts & Humanities Research Council, and partnerships with the
universities of Sussex and Brighton. Year by year, we build the number
of images, object records and related interpretation on the Royal
Pavilion & Museums website, which received over 318,000 visits in
2010-11.
o Both Brighton Museum and Art Gallery and Hove Museum and Art Gallery
underwent major refurbishments in 2002 and since that time there has
been an ongoing programme of further gallery improvements as funding
is secured. For example at Brighton Museum and Art Gallery the
Egyptology Galleries and in 2012 the World Art Collections will be
redisplayed, and in 2013 if we are successful in achieving funding
there will be further improvements to display at Brighton Museum and
Art Gallery. "

Please find set out below the information in response to the above
request:

1:The size of the Brighton Sheepcoate valley former landfill toxic

site.

With regard to the surface area of the former Sheepcote tip we have
endeavoured to produce an approximate measurement. this is based upon
inspection of plans, enquiries of others and local knowledge of this tip.
We have also been checking the history of the site and our measurements
suggest a total area of 34 hectares or 84 acres.

2:The legal status of the site:Is it classified as waste land,

agricultural land, etc etc?

In respect to the site's lawful planning use there are a mix of uses.
However, in general, these are considered to fall within the D2 use class
which relates to assembly and leisure uses or sui generis (their own
specific use). The Environmental Health Department would suggest that the
land is potentially contaminated land until proven otherwise.

3:What is the planning permission status of the site?

The inquiry covers the whole of the Sheepcote Valley site. The whole
area, excepting the Stanley Deason/City College campus, is outside the
built up area boundary. Parts of the Northern and Eastern slopes are
within the South Downs National Park which is a designation that offers
formal recognition of the South Downs special qualities in terms of
natural beauty and opportunities for open-air recreation and provides the
highest level of landscape protection under the planning system.

The area beyond the urban boundary including the sports pitches and camp
site as well as the civic amenities site are covered by the Local Plan
policies NC5, NC6 and NC8 (and NC7 where adjacent to the National Park
boundary) which generally discourage development outside the built up area
subject to certain exceptions. Where these exceptions are met the policy
gives guidance on appropriate unobtrusive development.

Approximately half of the area (including most of the Eastern and northern
slopes) is covered by a designation as a Site of Nature Conservation
importance under policy NC4 (available on the Council's website). Part of
the site is an Archaeologically Sensitive Area which is covered by Local
Plan policy HE12.

Most of the area including East Brighton Park is regarded as public open
space in use for recreational enjoyment. Local Plan policies QD20 and SR20
would therefore also apply. There would be a planning objection to the
loss of open access to these areas. The various community uses on the
site would also be covered by Local Plan policies HO20 and SR21 which in
general seek the retention of community use subject to certain exceptions.

In view of the past history as a waste site much of the Valley would also
be covered by Local Plan policy SU11 which relates to polluted land and
buildings. The site's variation in contours may also require regard to be
given to Local Plan policy SU8. In addition to this, depending on the
nature of any proposals for this site, other planning policies may also
apply.

The emerging Core Strategy policies are akin to the Local Plan in respect
of this site.

4:When was the site last used as a public waste dump?

Records from the Environment Agency who are responsible for issuing an old
waste management licence and waste in general indicate that it was a
corporation landfill from 1913 up until 1982. It is thought that
incineration at the site ceased in 1953.

5:What is known about the toxicity of the former dump?

The site is known to be a closed landfill which received industrial,
commercial and household waste. The landfilling operation is thought not
to have extended along the whole valley and more accurate records are held
by the Environment Agency over delination of the tipped areas.

6:What safeguards and monitoring are in place by the Council re the

toxic waste on the site?

Toxic waste is a rather umbrella term. It is feasible to expect that the
site has contaminants present by its very nature as a former landfill site
used over many years. Weekly monitoring for gas concentrations and gas
composition is carried out by a consultant on behalf of the City Clean
Team. Regular testing of the perimeter bore holes is a site licence
requirement but to demonstrate good practice the sampling has included the
emissions from the central vents. The latter are the visible ends of a
passive ventilation system laid over the licensed infilled area as part of
the land remediation scheme. The gas testing looks for levels of Oxygen,
Carbon DiOxide, Methane and more recently has included Hydrogen Sulphide -
levels recorded at the bore holes have to date been well below the trigger
levels set by the site licence. Higher levels have been recorded at the
vents, but this is expected and shows the vents are functioning correctly.
In an open environment the levels of gas at the vents are not considered
to a risk to health.

The healthy growth of vegetation across the site is an indication of the
quality of the soil, the landfill capping ensuring that the waste remains
separated from the top soil covering.

Quarterly water samples are taken from bore holes at the southern end of
the site, in the base of the valley. The results from these samples are
compared to others taken from Southern Water Bore holes in the same
vicinity and from above the valley.

7:What precautions were taken to seal the former waste dump site

and prevent escape of toxic waste?

The land filling activates along the length of the valley were carried out
in compliance with the legislation that was applicable at the time. In
respect of the lower area of the landfill the last waste was accepted on
the site in the early 1970's and the site was then subject to a
restoration programme, closely monitored by the County Council and the
Rivers Authority - the latter becoming the Environment Agency and
fulfilling a similar environmental management role.

The industry standard from landfill closure included for the installation
of bore hole test points - allowing monitoring of any movement of gas
below ground level from within the waste. The construction of the site as
it was being infilled included ventilation pipes, which later
interconnected to the surface ventilation system and allows gas emitted
from within the deposited waste to escape. The vents are fitted with flame
traps, which in the event of an ignition seal the chamber and minimises
the risk of flashback.

After the closure of the site, sections of the lower area - which forms
the current licensed area - was used for the disposal of chalk spoil from
the sea front tunnel. This chalk was in the form of a slurry, which when
laid on the site formed a semi- impermeable cap over the top of the
original landfill capping.

8:What is the estimated amount of waste sealed into the site, in
tonnes?

Records relating to the waste deposited in the site were held by East
Sussex County Council - these were to our understanding not passed to
Brighton Council when they assumed responsibility for the valley. It has
not been possible to trace the location or the continued existence of site
records held by ESCC. The Environment Agency held records relating to the
final restoration of the site, but we have been advised that they did not
have records relating to the landfill activities.

The landfilled area followed the contours of the valley floor, so although
an estimate of the tonnage of waste deposited could be made based upon the
surface area, the depth of waste will vary and as a result the estimate
may be significantly inaccurate. The estimate would further vary on the
nature of the waste and compaction rates achieved.

9:What assessment of the danger of the site to the general public

has been made?

The site has been subject to a risk assessment and prioritisation in line
with the City Council's requirements under part IIA of the Environmental
Protection Act 1990. The site is identified as a category B site, with A
being the highest and warranting greater action than that of a lower
priority Category E site. The area used to the North as a BMX area was
recently examined to ensure that it was fit for use and analytical tests
carried out accordingly. It was determined as fit for its current purpose.

10:What samples have been taken (if any) by the Council of the

toxins on site, and what was the result of any tests, (if any) of

them?

A small area used as a travellers overflow has had extensive gas
monitoring over a year period in addition to intrusive samples. This
identified that the site does have contaminants that one would expect of a
closed landfill site.

11:What tests have been carried out, either by the Council, or it's

contractors, (if any) to detect and monitor any escapes of toxins

into the water table on-site and near by?

Water sampling is a site licence requirement and is carried out quarterly
by Southern Water's laboratory. Samples to date have shown the tested
parameters to be within the required limits. These results are included in
the annual report.

12:What are the legal requirements, (if any) of the Council to

remediate the toxic waste onsite at Sheepcoate valley?

As above, it is inappropriate to state the term toxic waste. There are no
legal requirements for the City Council to remediate the site. Sites are
required to be fit for purpose. This often requires severing or rather
ensuring that there are no significant pollutant linkages between source,
pathway and receptor in line with the UK's current best practice. We are
unaware of any current plan or plans to carry out remediation or either
indeed further work/s to characterise the site.

13:Has any estimate been made of the costs of remediation of the

site?

See Question 12 above.

14:What plans, (if any) has the Council to remediate the site?

See Question 12 above.

15:what plans, (if any) does the Council have to plant trees on the

site?

The question of trees was raised when it was suggested that the ground
vents should be raised - possibly disguised as trees. The response was
that the valley is not a natural habitat for tress and the current
planting was considered to be appropriate.

16:What plans, (if any) does the Council have to make use of the

site, for any purpose, in the future?

Appropriate use is already being made of the site. This includes formal
sports, informal recreation area, waste site, leisure/college provision,
caravan site, etc. There is a management plan which fundamentally
suggests the continuation of these uses.

17:What plans, (if any) does the Council have to fence off the

site, and erect warning notices regarding toxic hazards?

Corporate Health & Safety would, and do, manage the site in accordance
with information from the Environment Agency and the Health Protection
Agency. The erection of warning notices was considered - but rejected -
when the site was restored and more recently when concern was raised about
the raised levels at some of the vents. The open aspect of the site
quickly disperses the gas emissions and therefore the casual site users
were not considered to be at risk. This was not the case with the proposed
residential site, where the occupiers could potentially be exposed to
prolonged low level exposure - similar to the naturally occurring radon
gas in granite areas of the country.

Following the restoration of the site, it was stated that it would be
opened to public access - prior to this the site would remain closed and
fenced off. By local - but informal agreement with ESCC and subsequently
the EA, the public were allowed to use the site and have continued to do
so. Approximately 10 year's ago it was suggested that all of the fencing
should be removed - which triggered concern from the EA about the
accessibility of the vents and a requirement for them to be fenced off or
raised to three meter height. The environmental / visual impact and of
course the cost of this work was rejected by BHCC and, although the site
has remained open, the fencing has remained in place - with neither the
Council nor the EA progressing or requiring the site to be formally agreed
as being open to the public.

This means that should it be necessary at any time the site can be closed
without prior notice or legal support.

18:What attempts, (if any) has the Council made to obtain funding

to remediate the site?.
