Thank you for your enquiry which has been logged under the above
reference. Having completed my enquiries I am able to respond as follows:

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities. Unless exemptions apply, the first duty at
Sec1(1)(a) is to confirm or deny whether the information specified in a
request is held. The second duty at Sec1(1)(b) is to disclose information
that has been confirmed as being held. Where exemptions are relied upon
s17 of FOIA requires that we provide the applicant with a notice which: a)
states that fact b) specifies the exemption(s) in question and c) states
(if that would not otherwise be apparent) why the exemption applies.

In respect of your enquiry:

 

1. The number of burglaries reported in the town of Brentwood since
January 2012.
2. The number of solved burglary cases.

  

The information sought is available via the Crime Mapper website
[1]www.police.uk therefore the exemption at section 21 of the FOIA
applies.

 

21 Information accessible to applicant by other means

(1) Information which is reasonably accessible to the applicant otherwise
than under section 1 is exempt information.

(2) For the purposes of subsection (1)—

(a) information may be reasonably accessible to the applicant even though
it is accessible only on payment, and

(b) information is to be taken to be reasonably accessible to the
applicant if it is information which the public authority or any other
person is obliged by or under any enactment to communicate (otherwise than
by making the information available for inspection) to members of the
public on request, whether free of charge or on payment.

(3) For the purposes of subsection (1), information which is held by a
public authority and does not fall within subsection (2)(b) is not to be
regarded as reasonably accessible to the applicant merely because the
information is available from the public authority itself on request,
unless the information is made available in accordance with the
authority’s publication

 

Section 21 of the Act (Information Reasonably Accessible by Other Means)
states that information is exempt information if it is reasonably
accessible to the applicant otherwise than under Section 1 of the Freedom
of Information Act 2000. Section 21 is an absolute exemption and where
information falls within the scope of an absolute exemption, a public
authority is not obliged to communicate it to an applicant and is also not
obliged to comply with the duty to confirm or deny the existence of the
information requested.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Essex Police and Crime Commissioner's handling of my FOI request 'Number of solved Burglaries in Brentwood, Essex'.

I don't believe the exemptions cited in your response apply here because:
From the website mentioned (www.police.uk), it is only possible to obtain
1. The number of burglary cases
2. The number of solved cases ( these cases include other types of crime, such as arson, drugs, etc.).
But it is not possible to get the information I am after, which is the number of solved burglary cases in particular.
As a victim of one such incident myself, I strongly believe that police owes public this information, as such an information gives public the statistical likelihood of getting back their stolen goods.

I have reviewed my FOI response, our reference 5642, following your email
received by this office on 5^th December 2013 requesting an internal
review; and after conducting some research into this matter I find that I
agree with you, the exemption at section 21 of the FOIA does not stand in
relation to part two of your request. It was our understanding that the
specific information that you asked for in part two of your request was
available from the Crime Mapper website as stated, however having
conducted further enquiries and checks I can see that we were mistaken in
this regard and on behalf of Essex Police I apologise for any
inconvenience this has caused you.
 
The exemption at section 21 of the FOIA still applies to the information
requested at part one of your request but due to the error of mistakenly
applying the exemption to the whole request in my previous reply I have
chosen to provide all the information relevant to your request
(information pertaining to part one of the request is provided outside of
the scope of the FOIA). Please find my revised reply below:
 
FOI request 5642
1. The number of burglaries reported in the town of Brentwood since
January 2012.
2. The number of solved burglary cases (these cases include other types
of crime, such as arson, drugs, etc.).
 
Brentwood District comprises 4 neighbourhoods, namely Brentwood Town
Centre, Brentwood North, Hutton, and Brentwood South.
 
For the purpose of this FOI request, “town of Brentwood” has been taken to
mean the two beats known as ‘Brentwood South’ and ‘Brentwood North’ that
collectively form the Brentwood Town Centre neighbourhood (NB the naming
of beats and neighbourhoods are different i.e. Brentwood North beat is not
in Brentwood North neighbourhood and Brentwood South beat is not in
Brentwood South neighbourhood).
 
During the period 1 January 2012 to 15 December 2013 there were 229
offences of burglary reported (and, of these, one case was later
determined not to have been an offence leaving 228 recorded crimes in this
period).
 
During the period 1 January 2012 to 15 December 2013, 32 offences of
burglary in Brentwood Town Centre neighbourhood were solved.
 
The above figures represent all offences of burglary that have been dealt
with by Essex Police i.e. they include burglary of dwellings, garages,
sheds, and commercial premises.
 
I hope this information is of assistance. If you remain unsatisfied with
