Further to your request for information under the ‘Freedom of Information’
Act; Market Charges, Selby Town Council do not provide stalls therefore
Traders bring their own stalls and we charge them a cost per foot for area
allocated to them.  We do not charge them per metre as this has never been
considered as an issue.  You mentioned that market traders have been
prosecuted by councils for failing to use metric prices, I assume you mean
metric weights.  We do not have any jurisdiction over what or how the
traders sell their goods, however I feel sure that the fruit and vegetable
stalls and other stalls that sell goods by weight could sell by kilograms
(kg) as well and/or pounds (llbs).   The Markets Manager will take your
comments/question to the next Market Working Group meeting for their
consideration in the new year.

Thanks for your response. I think you may have misunderstood the request because it wasn't clear. Let me reword it:

The council is breaking the law by using a primary non-metric price of £1.50 per foot. Official and primary prices must be metric. An equivalent price in non-metric units may be provided but only if secondary to the official primary metric price.

Thus the following are legal:

'£4.92 per metre'
'£4.92 per metre (approx £1.50/ft)'

'£4.92 per metre, charged in multiples of £1.50'
'£4.92 per metre (approx £1.50/ft), charged in multiples of £1.50'

Selby Town Council do not hold a policy or procedure with regard to market
fees and charges.  The fees and charges are approved at the Council’s
annual budget meeting.

 

We are currently awaiting advice from NABMA with regard to your suggestion
that the Town Council is breaking the law with regard to metric prices,
once we receive the advice from NABMA I will respond to this part of your
FOI request.

and LACORS with regard to charges per foot/per metre.  The information we
have received is ambiguous however we have updated our website stating the
market pitches with the metre unit of measure and on any future
documentation or agreements with traders we will use metres instead of
feet in future.
