Dear Leeds and York Partnership NHS Foundation Trust,

I am writing to request information under the Freedom of Information Act 2000.

I would like to receive information relating to the number of patients detained and the number of patients discharged under various sections of the Mental Health Act from January 2018 to September 2020.

Please can you provide the following information:

1. The number of people detained under Section 2 of the Mental Health Act from 2018 to date. Please provide a monthly breakdown of these figures for the years 2018 and 2019, and a weekly breakdown for 2020.

2. The number of people discharged under Section 2 of the Mental Health Act from 2018 to date. Please provide a monthly breakdown of these figures for the years 2018 and 2019, and a weekly breakdown for 2020.

3. The number of people detained under Section 3 of the Mental Health Act from 2018 to date. Please provide a monthly breakdown of these figures for the years 2018 and 2019, and a weekly breakdown for 2020.

4. The number of people discharged under Section 3 of the Mental Health Act from 2018 to date. Please provide a monthly breakdown of these figures for the years 2018 and 2019, and a weekly breakdown for 2020.

5. The number of people detained under Section 37 of the Mental Health Act each week from 2018 to date. Please provide a monthly breakdown of these figures for the years 2018 and 2019, and a weekly breakdown for 2020.

6. The number of people discharged under Section 37 of the Mental Health Act each week from 2018 to date. Please provide a monthly breakdown of these figures for the years 2018 and 2019, and a weekly breakdown for 2020.

Please break down all the above information by age, gender and ethnic background.

Thank you for your email requesting information from our Trust.

Having looked at your request we are seeking clarification on the following points;

You have asked a number of questions, for which you would like the data breaking down "monthly for the years 2018 and 2019, and a weekly breakdown for 2020" - further broken down "by age, gender and ethnic background".

Please could you clarify whether you are able to refine your request to a more manageable level?

As well as the risk that providing such detailed information may have the potential to identify the individuals represented - there is also the problem that reporting such detail, for such a lengthy period of time would mean compiling a spread-sheet to represent each month, and each week for each question asked (approx. 24 months plus 40 weeks, multiplied by 6 questions = approx. 384 spread-sheets.

As an example, I have attached a simple spread-sheet showing only (first page) The total number of people seen by adult Mental Health Services in the financial year 2018/19, broken down by ethnicity, gender and age (second page) Numbers of patients on a MH Section in the financial year 2018/19, broken down by Ethnicity. Would something like this be acceptable in response to each question (per year instead of 'per week')?

* Please note: the Freedom of Information Act imposes a statutory limit, known as the "appropriate limit" on the amount that can be spent on locating and extracting the information required to answer a Freedom of Information request. This limit is currently set at £450, which the legislation deems to be equivalent to 18 hours of staff time.

As advised, we require clarification of the points raised before we can proceed with compiling our response to ensure that we are providing the appropriate information that you require.

Whilst we are awaiting your clarification, we will place your request “on hold” until we receive your response, extending the 20 working day timescale. Should we not receive your clarification within 20 working days, we will consider your request closed.
