Number Of Operations Undertaken

The request was refused by University Hospitals of Leicester NHS Trust.

Dear University Hospitals of Leicester NHS Trust,

I am currently researching local NHS ENT surgeons and would greatly appreciate if you could assist with this.

Please could you tell me the number of operations performed by Mr Abdul Juratli, in the ENT department of the LRI, from 2008 until the present day (or the most recent date available)?

Please could you tell me the number of operations performed by Dr S Das, in the ENT department of the LRI, from 2008 until the present day (or the most recent date available)?

Yours faithfully,

Rebecca Ledwith

Dear Ms Ledwith

Request for Information

Thank you for your Freedom of Information Act (FOI) request, as received
on 22 April 2016.   For information, the University Hospitals of Leicester
NHS Trust is one of the largest and busiest NHS teaching Trusts in the
country incorporating the General Hospital, Glenfield Hospital and Royal
Infirmary.  The three hospitals are staffed by almost 11,000 people
serving around one million people across Leicester, Leicestershire and
Rutland, and a further two to three million people from the rest of the UK
who come to us for the specialist services we provide.  During 2014/15
Leicester’s Hospitals treated 1,229,500 (3,368 patients per day) – 97 more
each day than in 2013/14.

Your request is set out below, followed by the Trust’s response:-

Please could you tell me the number of operations performed by Mr Abdul
Juratli, in the ENT department of the LRI, from 2008 until the present day
(or the most recent date available)?

Please could you tell me the number of operations performed by Dr S Das,
in the ENT department of the LRI, from 2008 until the present day (or the
most recent date available)?

I confirm that the Trust holds information covered by your request.
However, it is the Trust’s view that the information requested by you is
exempt from disclosure under section 40(2) of the Freedom of Information
Act 2000 (personal information about a third party), and it is not
therefore being disclosed.  The Trust considers that individual clinicians
would have a reasonable expectation that this information about them would
not be disclosed under FOI.

The Trust’s Medical Director considers that while it is reasonable that
patients should expect clinicians to answer a question as to how many of a
particular procedure/treatment they have undertaken, this should be
covered as part of an informed discussion with that patient about their
care and their treatment options.  Raw system data on patient episodes (as
patients are coded as being under the care of a specified individual
Consultant) may also not reflect the true picture in terms of the
operating Consultant.  I am also advised that some national validated,
risk-adjusted Consultant outcome data is already available in the public
domain.

I am sorry that the Trust has not been able to provide information on this
occasion. If you require any further assistance please do not hesitate to
contact me.  If you are dissatisfied with the Trust’s response, you can
contact the Director of Corporate and Legal Affairs on Tel. No. 0116 258
8615 to request a copy of UHL’s Freedom of Information Act complaints
procedure.

We must advise you that where we have provided information we have done so
subject to the provisions of the Re-use of Public Sector Information
Regulations 2005.  Accordingly you must not re-use this information
without having the consent of the Trust.  Where the Trust is prepared to
provide its consent then it may levy a charge for doing so. Should you
wish to re-use documents provided then you must make your request in
writing stating your name and your address for correspondence together
with the document that you wish to re-use and the purpose for which the
information is to be re-used.

In the event that you remain dissatisfied with the way in which the Trust
has handled any complaint that you may wish to make, we would advise you
of your right to complain to the Information Commissioner at the
Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow,
Cheshire, SK9 5AF.

Yours sincerely,

Dear University Hospitals of Leicester NHS Trust,

Thank you for your reply, and I am disappointed by your response.

I note that in a previous FOI response to somebody else that you did provide this information in relation to individual surgeons. Please can you clarify why the Trusts position has since changed?

Yours faithfully,

Rebecca Ledwith
