Number of Nuisance Smell Complaints
Dear Peterborough City Council,
Under the Freedom of Information Act, I would like to request the number of nuisance smell complaints received by the council for the following periods:
1st Jan 2024-29th February 2024
1st Jan 2023-31st December 2023
1st Jan 2022- 31st December 2022
1st Jan 2021- 31st December 2021
To be clear, I am referring to complaints made about nuisance smells that could be a ‘statutory nuisance’ (covered by the Environmental Protection Act 1990) as defined in this guidance from the Department for Environment, Food & Rural Affairs: https://www.gov.uk/guidance/nuisance-sme...
If possible, please could you break down the number of odour complaints, by type.

NB: Section 79(1)(d) states "any dust, steam, smell or other effluvia
arising on industrial, trade or business premises and being prejudicial to
health or a nuisance;". The guidance document referenced in the FOI
requester
([2]https://www.gov.uk/guidance/nuisance-sme...
) clarifies this stating "Statutory nuisance laws don’t apply to smells
from residential properties." Hence the data only includes complaints that
would fall into Section 79(1)(d) and does not include any complaint about
odour from domestic premises which is not covered by statutory nuisance
law.
In addition, it should be noted that smoke emissions are dealt with under
a Section 79(1)(b) of the nuisance regime, and again have not been
included.
