FOI, England (NHS ENGLAND), Midlands and Lancashire Commissioning Support Unit

Dear Uzair Ahmed,

Re:      Freedom of Information request (Our Ref: FOI-057248)

Thank you for your Freedom of Information (FOI) request dated 31 August
2018.

Your exact request was:-

“Dear Midlands and Lancashire Commissioning Support Unit,

Under the Freedom of Information Act I would like to request the following
information:

1- Total number of non EU/EEA staff working in Finance & Information
Department.

2- Total number of non EU/EEA staff working on Tier 2 in Finance &
Information Department.

3- When was the last appointment made in the Finance & Information
Department and who was selected for the post, ie EU/EEA or non EU/EEA

4- When was the latest Tier 2 issued in the Finance & Information
Department and what was the postition/post?.”

NHS England are answering this FOI request on behalf of Midlands and
Lancashire Commissioning Support Unit.

NHS England holds recorded information in relation to this request.

We consider this information to be exempt under section 40 of the FOI Act.

In relation to questions one and three, Information is exempt under
section 40(2) where that information constitutes personal data (other than
that of the requester) and one of the conditions set out in section 40(3)
is satisfied. Under the FOI Act disclosure of this information would
contravene data protection principles. Section 40(2) is an absolute
exemption and therefore not subject to the public interest test when
considering disclosure of information.  Where a number of individuals is
less than or equal to five, we are unable to disclose the exact number of
individuals.

We consider that the disclosure of this information could breach an
individual’s confidentiality, as there is a risk that individuals may be
identified if this data is put together with other information that is, or
may become, available on that individual.  We believe that this could
cause unnecessary or unjustified distress or damage to the individual in
question, and would therefore contravene the principles of ‘fairness’ as
defined by the Data Protection Act.

In relation to question two, NHS England can confirm there are no non
EU/EEA staff working on Tier 2 in the Finance and Information Department
of Midlands and Lancashire CSU.

In relation to question four, NHS England can confirm that there have been
no Tier 2s issued in the Finance and Information Department of Midlands
and Lancashire CSU.

We hope this information is helpful. However, if you are dissatisfied, you
have the right to ask for an internal review. This should be requested in
writing within two months of the date of this letter. Your correspondence
should be labelled “Internal Review” and should outline your concerns
and/or the area(s) you would like the review to consider. Internal Review
requests should be sent to:

Email: [1][Midlands and Lancashire Commissioning Support Unit request email]

Please quote the reference number FOI-057248 in any future communications.
