Dear Peter,

Thank you for your response. I note that in your letter you state ;-
"Given this and having checked our records since 2014 I can find no evidence of HSE having led any investigation into incidents involving passengers on-board UK registered commercial aircraft."

Does this mean the HSE has not been involved in the investigation into any fume event incidents in any way involving passengers on-board UK registered commercial aircraft?

Please see response below to your question in your e.mail dated 4 June.

 

“We have found no record of HSE being involved in an investigation into
fume related incidents involving passengers on UK registered aircraft
since 2014.

 

As noted in the annex to the Memorandum of Understanding between the HSE
and the CAA (CAP 1484) the HSE has responsibility 'for regulating the
occupational health and safety of all work activities on and around an
aircraft on the ground, except the activities of crew members whilst they
are on board the aircraft. This means it is unlikely that the HSE would be
involved in investigating incidents of the type you describe.”

Thanks you for your response.

You state i is unlikely that the HSE would be involved in investigations in relation to incidents invilving passengers on UK Aircraft.

I have looked at the MoU between the CAA and the HSE and it clearly shows that the HSE does have responsibility for occupational health and safety issues affecting employers, employees (except crew members on board the aircraft) the self-employed, and passengers during such time as the aircraft is on the ground with the doors open, or the aircraft is manoeuvring or being manoeuvred on the ground without the intention of flight.
In this MoU it also states the HSE will raise with the CAA concerns if they believe that an aircraft or its operation poses risks to the occupational health and safety of crew or passengers on board whilst it is in flight within GB airspace

So clearly the HSE does have the responsibility for aspects of Heath and Safety in relation to UK registered aircraft, their passengers and crew. I am therefore surprised that you are telling me the HSE has no records of any investigations.

In the Mou it specifically states in Annex 8 page 11 that it is the HSE who hold the Health and Safety regulatory responsibility in respect of exposure to hazardous substances within the aircraft in relation to " risks to occupational health and safety of non crew members and that any such exposures are being adequately controlled."

Can you tell me why when there have been many recorded incidents on UK registered aircraft of passengers being exposed to toxic and hazardous substances the HSE has not carried its regulatory responsibility.
