Number of empty houses in the borough

We're waiting for amy macdonald to read recent responses and update the status.

Dear Kirklees Borough Council,

Please can you provide me with a list of all properties that have been empty for the last 6 months within kirklees borough under The Freedom Of Information Act 2000 .No personal details please, just the addresses according to the government advisor and from emptyhomes.com.

"The legal position on dealing with a request for details of privately owned empty property seems to be clear.

The Freedom of Information Act gives people the right to request information on empty properties; the information is not normally covered by the exemptions in the act. The Data Protection Act does not does not restrict the disclosure of addresses of empty properties, as they are not considered personal information, but may apply to ownership details.

Unless there are particular circumstances, which in the local authorities view cause the request to fall within one of the prescribed exemptions, the local authority is, obliged to disclose a list of empty privately owned property within its boundary on request within 20 days."

The Council’s response to your specific questions is set out below:

 

The Council can confirm that it does hold the information requested, but
is refusing to release this information.  Please find attached the refusal
notice which sets out the reasons why and the process of appeal against
this refusal.
