I am looking to find out the number of DVPN's that have been issued since
implementation into practice and; if the information is held, the gender
and sexual orientation of the recipients.

 

 

RESPONSE

 

Our data are not organised in such a way as to allow us to provide this
information within the appropriate (cost) limit within the Freedom of
Information (FOI) Act (see ‘Reason for Decision’ below).

 

However rather than refusing your request outright at this stage, I would
like to explore with you how West Midlands Police may best assist you to
request relevant information which we hold. Within the cost limit we could
search for the number of DVPN’s issued since implementation until 21/6/18.

 

Please note that any located information might be subject to the
application of exemptions under the Act.

 

To enable us to proceed with your request I would be grateful if you could
confirm whether you wish us to provide the information outlined above.
After receiving your reply, your request will be considered and you will
receive a response within the statutory timescale of 20 working days, as
defined by the Act, subject to the application of any statutory
exemptions. If you chose not to respond then your request will remain
unanswered.

 

 

REASON FOR DECISION

 

Please note that researching each individual case would exceed the
appropriate limit (FOIA, s.12 (1)). We don’t ask for a person’s sexual
orientation,  in order to try and locate and retrieve that  information we
would need to conduct a manual search which would exceed the 18 hours.

 

The cost of compliance with the whole of your request is above the amount
to which we are legally required to respond, i.e. the cost of locating and
retrieving the information would exceed the appropriate costs limit under
section 12 of the FOI Act 2000. For West Midlands Police, the appropriate
limit is set at £450, as prescribed by the Freedom of Information and Data
Protection (Appropriate Limit and Fees) Regulations 2004, S.I. 3244.

Thank you for your response. It was my understanding that these orders were implemented prior to this year and were initially introduced in 2014. I would however, be grateful for the information that you have on record regarding the number issued to date and the date of implementation.

I am also seeking some further information:

1. What is the policy for equality and diversity monitoring for a person who reports a crime; namely for those who fall within the category of domestic violence victims?

2. How many referrals have been made to MARAC and what was the sexual orientation and gender identity of those referred?

3. Does the West Midlands have specialist Domestic Violence officers?

4. What training do officers receive around dealing with victims of domestic abuse?

5. Is there specialist training for dealing with victims or who are LGBT and/or heterosexual males?

6. What services do the police refer LGBT and heterosexual males to?
