(“SRA”) requesting information. I am treating this as an information
request under the Law Society Freedom of Information Code of Practice
("the Code").

out its regulatory functions. The Law Society is not covered by the
Freedom of Information Act (the FOIA) as it is not a designated authority,

Further to my colleague Joao Curro’s email of 11 February 2015, please
find below the response to your information request under the Law
Society’s Freedom of Information Code of Practice ("the Code").

 

You have requested access to the following information:

 

 

“Please can I request details the number of  complaints against Mr Justin
Philip Huntly Nelson and  Nelson's  Legal of Bell House Tenterden Kent,
whether upheld or not.”

 

 

I am withholding any complaints information about Mr Nelson under Section
16 of the Code. This section of the Code states that we cannot disclose
personal information about someone else. To do so would be a breach of the
Data Protection Act 1998.

 

According to the Solicitors Regulation Authority (‘SRA’) system, the firms
with “Nelson” in the title at the address you mention above are; NELSONS
PROPERTY LAWYERS 522802 and NELSONS 486743. Both were trading names for
NELSONS 74957 which closed on 29 December 2013.

 

NELSONS was a sole practitioner's office for Mr Justin Philip Huntly
Nelson 116040. The SRA does not hold a current place of work for Mr
Nelson.

 

I can confirm that Mr Justin Philip Huntly Nelson holds a current
practising certificate free from conditions. There are no Findings and
Orders that have been made by the Solicitors Disciplinary Tribunal (SDT)
against Mr Justin Philip Huntly Nelson.

The number of complaints constitute personal data about Mr Nelson
therefore it is exempt from disclosure under Section 16 of the Law
Society’s Freedom of Information Code of Practice. To disclose this
information into the public domain would be a breach of the Data
Protection Act 1998.

 

Personal data means data which relate to a living individual who can be
identified –

(a) from those data, or

(b) from those data and other information which is in the possession of,
or is likely to come into the possession of, the data controller,

and includes any expression of opinion about the individual and any
indication of the intentions of the data controller or any other person in
respect of the individual.
