- a money judgement for the claimants in default of a defence being filed by the defendants

- a money judgement for the claimants after a hearing

- the claimant's claim being dismissed or struck out

- the claimant's claim being withdrawn or discontinued

thank you for your letter in which you advised that, as at 28/2/2012, 28 claims had been issued by Legal Parking Enforcers (UK) Limited and they had obtained default judgments in 21 of these cases.

I would be grateful if you could provide some information as to what happened on the other 7 cases. Presumably they were defended such that they were transferred away from The Bulk Centre to the defendants' home courts.

You should, I hope, be able to send an e-mail (the same e-mail)to the court manager at each of the courts concerned asking what the results were in each of these these seven cases, ie:-

- judgment for claimant after a hearing;

- claim dismissed after a hearing; or

- claim withdrawn

Thanks for your follow up question in relation to your Freedom of Information request.

II would like to clarify a couple of general points in relation to claim issue and my initial response.

Once a claim is issued via MCOL and a defence is received from the defendant the claim is transferred to the defendant's local court. The initial search conducted would only include cases held at the MCOL office of which 28 cases were found.

Any cases issued through MCOL but now held at another court would not be located in the initial search. A further search would need to be made by each court for any records on their own court record.

The law allows us to decline to answer requests under FIOA when we estimate that it would cost us more than £600 to confirm that the department holds the information requested. You may me interested to know that the limit is equivalent to 3½ working days' worth of work, calculated at £25 per hour.

As there is no central database on claims within HMCTS in order to establish whether any information relevant to your request is held and provide you with the information on the scale that you have requested would involve contacting every court in England and Wales. There are approximately 210 county courts and we have estimated that it will take us in excess of 3.5 working days to determine appropriate material within the scope of your request, and locate, retrieve and extract that information.

You may wish to narrow the scope of your request in order to try and bring it within the cost limit by being more specific about which information you wish to receive for example, specifying a particular Court.

Outside of the Act, it may be helpful if I advise that even if you refine your request, it may still evoke some other exemptions such as Sections 32 (court records) and 40 (personal information) of the FOIA.

You may be able to apply to the appropriate courts under the Civil Procedure Rules, Part 5.4 for a copy of the statement of a claim and a copy of any judgment. This may attract a fee. You may also be able to obtain information regarding any judgments from the Registry Trust. They can be contacted at http://www.trustonline.org.uk/ or 020 7380 0133.

Dear Mr Stanley,

As I understand it MCOL claims are issued out of Northhampton County Court.

Surely Northampton County Court can look up to which county courts the claims concerned were transferred? We are, after all, only talking about seven individual claims.

Then an e-mail (the same e-mail)could be sent by you (or by the court manager at Northhampton County Court or by some other official employed at public expense) to the court managers at each of the county courts concerned.

Really I still fail to see that it should be either costly or difficult to get the information sought.

Are you saying that it is not possible for Northampton County Court to determine which of the 7 out of the 28 claims issued by Legal Parking Enforcers (UK) Ltd have been transferred out? If so why would this be?

Even if it were the case that someone had to look through a list of all 28 cases to find out which ones were transferred out I find it hard to believe that it would take 3.5 days to do so.
