Number of Claimants with More Than One Spouse

Dear Department for Work and Pensions,

We were asked to revise a FOI request which you claimed exemption for under section 12 of the relevant act.

We are in the process of doing so, but in the mean time we would like you to provide the following information.

1) The number of claimants per benefit type who also claim for more than one spouse, broken
down by ethnicity, where provided by the claimant, and grouped by tax year (obviously starting in the current tax year and going back as far as the section 12 limit allows).

Please pass this on to the person who conducts Freedom of Information reviews.

We are writing to request an internal review of Department for Work and Pensions's handling of our FOI request 'Number of Claimants with More Than One Spouse'.

You have refused the request citing a section 12 exemption, however, in separate correspondence on FOI requests made by others you reveal that this data is stored electronically and is a simple matter of automatically retrieving the information after running a query.

You have also already confirm to us that this data is held, thus not requiring to be confirmed it is held, which reduces the time spent checking for it.

We therefore reject the section 12 excuse because there is no possible way that it would take 3.5 days to retrieve this information. We have several former DWP employees and technicians who are willing to testify that this information is readily available and retrievable, so we would appreciate it if you simply provide that information without the need to go through an expensive court case in which you will inevitably lose.

We ask again that this information is provided without any further delay and excuse, and to avoid expensive litigation for which all costs will be claimed.
