Thank you for your email below regarding the above subject matter.

In order to process you request and to provide you with the correct information. I would be grateful if you can you please clarify the following

1. How many appeals against removals in the month of June and August (2011) have been successful at the first tier tribunal that UKBA did not seek permission to appeal?

With regard to question 1, technically individuals do not appeal against removals, they appeal against the refusal of an in country application. We can provide data on the number of appeals that were successful in June 2011 and August 2011, at the first tier tribunal, where UKBA did not seek permission to appeal this decision in the upper tribunal.

3. What percentage of those appellants have yet been issued with status documents?

With regard to question 3, please ask the you clarify what is meant by status document. If it means appeal determination, then we can provide data on the number of determinations issued following the outcome of appeals in question 1.

Once we receive a clarified response, we will process your request. If we do not receive a response within three months of the date of this email we will consider this request as closed.

Dear Freedom Of Information Team ( IND ),

Can you please provide the data on the number of appeals that were successful in June 2011 and August 2011, at the first tier tribunal, where UKBA did not seek permission to appeal this decision in the upper tribunal.

I am specifically interested in the appeals of those whom UKBA tried to remove but failed after the appellant went to court.

How many of those appeal determinations have been determined and the appellant with immigration status documents?

Yours sincerely,

peppe kalle

Dear Peppe Kalle

Thank you for your email below.

With regard to Q.1, as explained we do hold data on applicants that appeal against removal. Applicants cannot appeal against removal, they can only submit a Judicial Review or submit Further Representations which will be considered. An applicant can only appeal against a refusal decision after which removal directions will be set. We hold data on applicants that have appealed against the refusal decision and have been successful in June 2007 & August 2007

Please confirm if this is the data you require.

With regard to Q.3 - As requested below, please could you clarify what is meant by status document. We can only provide figures on the number of successful appeal determinations following on from question 1.

Please let us know whether this is the information your require.

Regards
