Nuclear Secratariat

Response to this request is long overdue. By law, under all circumstances, Ministry of Defence should have responded by now (details). You can complain by requesting an internal review.

Dear Ministry of Defence,

I have just recieved a letter from the Nuclear Secratariat in response to my letter to the MOD yet you have provided no information as to who this person is and the number provided on the letter is the main switchboard number who only put people through if that person has a contact name and/ or address.

So i require the following:-

1. Who is the Nuclear Secratariat who wrote the letter to me? REF number TO2017/0025

2. What is the Nuclear Secratariats full contact address?

I did not ask what the nuclear secretariat does. I asked for the name of the nucleat secretariat and his or her contact details, not the MOD main address. For clarity, if the nuclear secretariat is a team of individuals and not a singular person as the title implies, then what are the names of the persons who make up this team?

You were also late in responding to my request and gave no explanation as to why you were late in responding. Please explain the delay also.

Acknowledgement of Request for a Freedom of Information Act (FOIA) Internal Review

We acknowledge receipt of your email of 26 April 2017 and I can confirm that an internal review will be conducted of your request for information, our reference FOI2017/03560.

The Department's target for completing internal reviews is 20 working days from date of receipt and we therefore aim to complete the review and respond to you by 25 May 2017. While we are working hard to achieve this, in the interests of providing you with a realistic indication of when you should expect a response, we should advise that the majority are currently taking between 20 and 40 working days to complete.

The review will involve a full, independent reconsideration of the handling of the case as well as the final decision.

Once again, what is the reason for the exemption for question 1. And also what other means is the information to my second question available?

You still havent explained why you were late in responding to this request in the first place also. I expect a full explanation.

Having read your request and their responses it seems clear that:

Q1. They have correctly applied the Sect 40 exemption in response to your request for names of individuals employed by MOD - names are personal data and personal data is exempt under the FOI Act.

Q2. They explain in their letter that they were not late in replying, evident to you from reading this website and comparing dates, and so this is information available to you via other means.

In terms of the FOI Act I do not believe that there is a legal requirement to explain any delay, just to avoid it happening in the first place.

Yes they were late in responding to this request, evident by the dates on the request and the fact that I was prompted by the actual website who sent me an email informing me that by law they were meant to respond by a certain date and they did not. Also with regard to names, they are a public governmental body and just as judges and politicians identities are in the public domain then it is no different for other public bodies.

If you refuse to supply a name then supply a contact telephone number for that person so I may speak with them. It seems all of you at the MOD are extremely reluctant to enter into any dialogue with members of the public. Something to hide have we?
