In keeping with the Council’s commitment to deliver cost-effective
services, the nuclear team is funded via a number of agreements with
developers that enable staffing and other costs to be recovered. There is
zero net cost to the council associated with additional resource demands
placed upon the council by the presence of the nuclear industry in
Copeland.

 

Section 40(2) FOI Act – Personal Information

 

Details relating to Copeland Borough Council’s staff is personal data as
it relates to identifiable individuals therefore the exemption that
applies is S40(2), by virtue of section 40(3)(a) of the FOI Act (Personal
Information).

Section 40(2) in an absolute exemption in cases where disclosure would
breach any of the GDPR Principles.

Whilst it is appropriate to disclose some information relating to job
roles, there is no similar expectation that personal details of staff
members such as individual salaries for roles relating to 1x headcount,
would also be released into public domain as a result of being released
under a Freedom of Information request.

 

In accordance with S17(1) of the Freedom of Information act 2000 this note
acts as a refusal notice for this part of your request.

I am writing to request an internal review of Copeland Borough Council's handling of my FOI request 'Nuclear department'. My request was:

1. How many people are in your nuclear department?
2. What do they do (job titles please)?
3. How much do the earn (salaries each please).
4. How is the nuclear department funded?

For (4), you have answered that in keeping with the Council’s commitment to deliver cost-effective services, the nuclear team is funded via a number of agreements with developers that enable staffing and other costs to be recovered. There is
zero net cost to the council associated with additional resource demands placed upon the council by the presence of the nuclear industry in Copeland.

This does not meet the requirements of the FOI and relevant information can be provided. I require the names of the developers, information on the type of agreements and amount of money provided by the said developers each year to make the team zero net cost to the council.

You have refused the remainder of the request because details relating to Copeland Borough Council’s staff is personal data as it relates to identifiable individuals therefore the exemption that applies is S40(2), by virtue of section 40(3)(a) of the FOI Act (Personal Information).

This does not meet the requirements of the FOI and relevant information can be provided. As a minimum, I require a staff structure, total team cost per annum and a list of services provided by the team to the said developers.

I write in response to your request for a Review of the Councils' previous response your FOI request ref FOI 12336. I have now conclude my review and my findings are as follows.

Further to the previous response I have determined that the job descriptions can be released and please find them attached detailing duties, responsibilities and services provided. The total team cost per annum is £158,445.00.

I have no further information to disclose other than to explain the objectives of the Council's Nuclear team, which is to ensure that the Council, on behalf of Copeland's people, communities and environment, is able to meet the significant demands placed upon it by the nuclear industry. The Nuclear team is part of the wider Nuclear, Energy & Sustainability service, whose role includes understanding long term socio-economic impacts, and developing interventions to mitigate threats and maximise opportunities in pursuit of the Council's objectives, particularly in relation to economic development and diversification, and sustainability. The team's role involves:
* Enabling informed decision-making on nuclear matters as they may affect the social, economic or environmental prosperity of Copeland;
* Ensuring that maximum social and economic benefit is secured from the nuclear, energy and radioactive waste activities undertaken within the Borough, including legacy activities as well as potential future missions;
* Leading on the Council's Climate Action, making Copeland a sustainable place.

Like all council services, the team's primary goal is to serve people and communities in Copeland by contributing to the Copeland Vision 2040 and the council's corporate strategy and sustainability strategy.

This concludes my Internal Review of your request for information.
