Thank you for your response dated 9th April 2019. In the first instance, please could I request a copy of Highways England's Invitation to Tender document, or any similar document for the NRTS2 commission, which includes a breakdown and specification of what each interested party was required to include in their tender submission? I will then use this specification to advise you of any specific areas within the tender submissions that I would like to request extracts from.

I am writing to request an internal review of Highways England Company Limited's handling of my FOI request 'NRTS2 Tender Responses'.

I do not believe that Highways England have provided sufficient justification to withhold the information requested. They have also failed to comply within the timeframes required under the FOI regulations.

The tender documents for the NRTS2 commission clearly stated that information submitted by tenders could be subject to future FOI requests and that if tenderers objected to the release of any information, they had to specify that as part of their tender submissions. Highways England's response implies that no objections were raised by the tenderers at the time but that Highways England have since taken it upon themselves to consult the tenderers following my FOI request. I note that the tenderers have not provided any reasoning for objecting to release of this information.

Highways England also refer to the pricing mechanism as a reason for witholding the requested information. I did not ask for any information on pricing mechanism. I have not asked for any details of the commercial relationships between the sub-contractors and lead parties. I have simply asked for a named list of any sub-contractors included on each tender and I fail to see any reasons for witholding this information. As Highways England note in their response, transparency of tender information is in the public interest and beneficial to the whole process and therefore should be encouraged.
