I am writing to request an internal review of Highways England Company Limited's handling of my FOI request 'NRTS1 HE Tax Year Breakdown'.

My FOI requests made on 15th June 2020 were in no way intended to be vexatious and this would appear to be the latest attempt by Highways England to unreasonably refuse to release information under the FOIA.
Firstly, dealing with your claim that the requests made on the 15th June 2020 are overlapping. I would argue they are not. Firstly, some of the requests relate to the NRTS1 commission and some the NRTS2 commission. These commissions are separate entities in their own right and therefore it is justified to deal with these commissions within separate requests. Two of the requests relate to pension schemes, and the reason for separating these was because of the separate entities of the NRTS1 and NRTS2 commissions. None of my previous FOI requests have ever dealt with the topic of pensions. Even if Highways England wanted to take the position of grouping the two pensions requests together, the cost of responding to those would not even come close to the Section 12 limit.
Two of the requests relate to job titles which is again a completely different topic to pensions. And again, these have been split into the separate NRTS1 and NRTS2 entities. However, even if Highways England wanted to take the position of grouping the two job title requests together, the cost of responding to those would not even come close to the Section 12 limit.
Two of the requests relate to the specific topic of correspondence between the NRTS1 email address [email address] and Highways England, which is again a completely different topic to pensions or job titles. However, even if Highways England wanted to take the position of grouping the two job title requests together, the cost of responding to those would not even come close to the Section 12 limit.
The last request relates to the specific topic of correspondence between the NRTS2 email address [email address] and Highways England. This was issued as a separate request due to NRTS1 and NRTS2 being separate entities. Bur again, even if Highways England wanted to take the position of grouping this request with any of the others, the cost of responding would not even come close to the Section 12 limit.
Secondly, dealing with your claim that the requests are of a scattergun approach. The ICO guidance defines a scattergun approach as:
“The request appears to be part of a completely random approach, lacks any clear focus, or seems to have been solely designed for the purpose of ‘fishing’ for information without any idea of what might be revealed.”
As highlighted above, the requests issued on 15th June 2020 do not meet this criterion. There is a clear focus to each request meaning they cannot be considered random. Given that the requests have a clear focus, they also cannot be considered as ‘fishing’ for information without any idea of what might be revealed.
Thirdly, dealing with the last sentence of paragraph 3 in your letter where you state that you will be treating any further requests submitted by myself as vexatious. The ICO is very clear in that you cannot accuse the individual making a request of being vexatious. Section 14(1) of the FOIA can only be applied to requests themselves and not the individual making the request.
In summary, Highways England do not have grounds to apply either Section 14(1) or Section 12 to any of the requests made on 15th June 2020. I trust you will now proceed to supply the information requested in accordance with the FOIA for each request.
