reports, sub committee minutes and other documents mentioned in the minutes of this meeting.

Can you also provide a copy of the minutes and agenda, unless these have already been published on your website.

Bearing in mind your breech of the freedom of information act in respect of a similar request for board papers, can I remind you of your legal duties in respect of this request.

Dear Kelly Radley,

British Waterways were sent a letter by the Information Commissioners Office (dated 7/1/2011) reminding you of your responsibilities under the FoI Act and requesting that you respond to my request within ten working days.

You have not done so. Neither have you given any reason for delay.

As such you leave me with no option but to make a further complaint to the ICO.

I am aware that the ICO is very busy, so I would ask that you do not treat the complaint as a reason to delay the response to which I am entitled under law.

Further to your initial request of 26th November 2011 please find attached copies of the Property, Audit and Remuneration Committee minutes.

Information has been redacted from the Property Committee Minutes 4 May 2011, Property Committee Minutes 10Nov10, Property Committee Minutes 2 February 2011 and the Property Committee Minutes 25 November 2010 as it is exempt from disclosure under the provisions of section 43 (Commercial Sensitivity) of the Freedom of Information Act 2000 as disclosure would be prejudicial to the commercial interests of BW and third parties. Furthermore, the public interest in maintaining that exemption outweighs the public interest in disclosing the information.

If we haven’t reasonably met your expectations in relation to a request for information or you believe we may not have acted in accordance with the above legislation you should write in the first instance to Kelly Radley Head of Customer Relations, 64 Clarendon Road, Watford, Herts WD17 1DA outlining your concerns and asking for a review to be undertaken. Your correspondence will be acknowledged and a review of your case will be undertaken by one of British Waterways’ directors.
