Dear North Yorkshire County Council,

Are Third Energy legally obliged to publish notice of when they intend to start fracking in Kirbymisperton? If so, how far in advance of the start date must they give this notice? Additionally must a detailed schedule, beginning with the departure of the first lorry from Malton station, be given if requested?

Dear Mr Jolly,

 

Thank you for your recent request for information received on Sunday 10th
July 2016 timed at 20:54. Please note the following in response to your
request.

 

Your request is understood to be as follows:

(i) whether Third Energy are legally obliged to publish notice of when
they intend to start fracking in Kirbymisperton?

(ii) how far in advance of the start date must they give this notice? and,

(iii) must a detailed schedule, beginning with the departure of the first
lorry from Malton station, be given if requested?

 

In response:

(i) and (ii) please refer to Condition No. 3 of the Decision Notice issued
by the County Planning Authority;

iii) The Conditions provide that an updated Traffic Management Plan must
be submitted prior to any development (see condition 12) . However we are
unclear as to what information you are referring to in relation to “the
departure of the first lorry from Malton station”. We therefore cannot
answer this request without further details.
