Dear Medway Council,

Under the Freedom of Information Act (FOI), please could you
provide the following information regarding noise pollution
complaints for Licensed Premises licensed under the Licensing Act
2003) situated in the medway area for the period
2008 (advent of new Licensing Act 2003) to present, and if possible
broken down by nature of complaint as below:

A) Amplified Music & Speech
B) Mechanical noise
C) Behavioural noise

For each of the above categories, please provide a breakdown for:

1. No statutory nuisance found
2. Nuisance found, formal warning issued
3. Licence Review Hearing held
4. Licence or other conditions applied on Premises
5. Noise Abatement Notice issued

A suggested format would be tabular showing name of Public House;
Date, Nature of Complaint; Action taken; Remarks concerning
diaries/hearings; proximity of complainant to premises. If some
form of summary, whether tabular or list format, already exists
which may or may not include other types of premises, then this
would probably suffice.

Please provide advice on whether complainants were given official
diary sheets to record incidents of noise pollution

Please also provide the guidance or applicable criteria used in the
assessment of the above which shows the levels at which you would
deem a statutory nuisance to have arisen; for example frequency of
occurrence - X times per week/month/annum; and/or noise level
deemed a nuisance.

If not contrary to section 13 of The FOI can complainants addresses
be provided so that an assessment of proximity to the premises
complained about can be made. If not possible, can some proximity
figures from complainant to perceived nuisance be provided if
available.
