Freedom of Information Act 2000
Thank you for your request for information concerning the notes of
meetings of the Building Control Performance Standards Advisory Group for
2015 - 2018 and lists of the members (or their substitutes) attending each
meeting, which we received on 13 March 2019.
We are handling it under the Freedom of Information Act 2000.
We do hold information in scope of this request, but I am afraid that
I will not be able to give you a response within the normal 20 working
days. This is because I need additional time to give extra consideration
to the public interest in releasing it.
The Freedom of Information Act 2000 allows this when one or more qualified
exemptions apply to the information. In this case the exemption I am
considering is section 35(1)(a) which covers information relating to the
formulation or development of government policy.
I estimate that it will take an additional 20 working days to take a
decision on where the balance of the public interest lies. Therefore, I
will respond to you by 13 May 2019.

let us know by return email within two months of receiving this response.

I am writing to request an internal review of Building Regulations Advisory Committee for England's handling of my FOI request 'Notes of meetings of the BCPS Advisory Group and lists of attendees'.
It is now 3 months since 12 March 2019 when I made the following request for information:
"Please provide copies of the the Notes of meetings of the Building Control Performance Standards Advisory Group for 2015 - 2018 and lists of the members (or their substitutes) attending each meeting. (Publication of the Notes is required by the Group's Terms of Reference)"
I have been told on two occasions (10 April and 13 May) that you need additional time to give extra consideration to the public interest in releasing it, citing section 35(1)(a) of the FoIA.
I have now been told (June 10) that you need even more time to consider my request.
I am unhappy with these delays, as these Notes should already have been published under the Advisory Group's Terms of Reference. I find it very hard to believe that all the Notes from every meeting can be subject to section 35(1)(a). In addition, it is not credible that the lists of the members (or their substitutes) attending each meeting can be subject to section 35(1)(a) .
I therefore request an Internal Review.
