I am writing under the the Freedom of Information Act 2000 and/or Environmental Information Regulations act to request the following information regarding the Norwich Western Link Project:

-Reports on survey work carried out along Route B (East) in 2021 and 2022.

If it is not possible to provide the information requested due to the information exceeding the cost of compliance limits identified in Section 12, please provide advice and assistance, under the Section 16 obligations of the Act, as to how I can refine my request.

If you can identify any ways that my request could be refined I would be grateful for any further advice and assistance.

The requested information is not held. A consultant was commissioned to
carry out survey work and analysis which is due to be completed and
reported to NCC later this year. This will then be validated prior to
publication as part of the NWL planning application in the early part of
2023.

 

If you are dissatisfied with our handling of your request you have the

Your request is being processed under the Environmental Information Regulations 2004 as the information that you are requesting falls under the definition of environmental information.
Regulation 7 of the EIR makes provision for public bodies to extend the timescale for response:

7.-(1) Where a request is made under regulation 5, the public authority may extend the period of 20 working days referred to in the provisions in paragraph (2) to 40 working days if it reasonably believes that the complexity and volume of the information requested means that it is impracticable either to comply with the request within the earlier period or to make a decision to refuse to do so.

The department were contacted and have provided the attached information
regarding your enquiry.
 
Route B (East), 2021 & 2022 -  It has been identified that an
Arboricultural survey was undertaken during the period detailed within
your request, however no formal report will be produced regarding this
survey, and with no further work being undertaken, it will remain
incomplete.
 
Please find attached 3 documents, which provide the incomplete data
results held by the Council from this survey.
 
The document entitled “22 039 TS01 Rev A-s” appears at pages 2 and 10-18,
to have data missing, however, we can confirm that this is the most
up-to-date version held and this work was never completed.

Regulation 13 (1)
Some information has been redacted under Regulation 13(1) of the
Regulations which state that the Council is not required to disclose the
personal information of any other individual if disclosure would
contravene the rights of the individuals to whom the data relates.
 
The redacted data comprises of the following:

• Personal data of staff from external organisations

 
The exemption applies because:

• Members of staff, from external organisations, have a reasonable
expectation that their personal data would remain confidential.

 
Regulation 12(5)(e)
Regulation 12(5)(e) states that a public authority may refuse to disclose
information to the extent that its disclosure would adversely affect the
confidentiality of commercial or industrial information where such
confidentiality is provided by law to protect a legitimate economic
interest.
 
The information is the commercially sensitive data of third parties from
whom we do not have consent for release.
 
Public Interest Test Reasons
 
The Council has considered whether the public interest is maintaining this
exemption is outweighed by the public interest in disclosure.
 
This Council has considered the following reasons in favour of disclosure:

• Promoting accountability and transparency by public authorities for
decisions taken by them.
• Promoting accountability and transparency in the spending of public
money, and engagement in commercial matters.

 
Balanced against this are the following reasons against disclosure:

• Releasing this information could impede the County Council’s ability
to achieve best value and range of services for the people of Norfolk.
• This information is the commercial information of third parties and
was provided to the County Council with the expectation that it will
not be released into the public domain.
