1) Did anyone from the district council ever ask Gallagher Estates, L&Q, Homes England, and/or Anglian Water whether the Northstowe Phase 1 and/or Phase 2 surface water drainage systems have been built in accordance with the approved plans?
2) If so, could the district council please provide all such correspondence and/or any other documents recording any such information.
3) Does the district council hold any information indicating that any aspects of the Northstowe Phase 1 and/or Phase 2 surface water drainage systems have not been built in accordance with the approved plans?
4) If so, can the district council please provide all documents containing any such information.
In this request, the word ‘document’ means anything in which information of any description is recorded.
Regulation 5(2) of the Environmental Information Regulations 2004 provides that information requested under the Regulations should be provided as soon as possible. Given the high level of public interest in this matter, it is hoped that the district council will not wait 20 working days before responding.

I hope the information below will answer your query.
1) Did anyone from the district council ever ask Gallagher Estates, L&Q,
Homes England, and/or Anglian Water whether the Northstowe Phase 1 and/or
Phase 2 surface water drainage systems have been built in accordance with
the approved plans?
Response: Following a meeting with the Managing Director of L&Q in 2021,
the Joint Director of Planning emailed L & Q in January 2022 to enquire
about the post completion information on the Phase 1 drainage scheme. (see
attached)
2) If so, could the district council please provide all such
correspondence and/or any other documents recording any such information.
Response: Attached is the response from the Managing Director with
enclosures.
3) Does the district council hold any information indicating that any
aspects of the Northstowe Phase 1 and/or Phase 2 surface water drainage
systems have not been built in accordance with the approved plans?
Response: We can confirm that we do hold information as regards the
construction of Northstowe Phase 1 and Phase 2. The investigation of the
phase 1 drainage system is ongoing and no conclusions can or have been
drawn on this matter based upon the material provided to date.
4) If so, can the district council please provide all documents containing
any such information. In this request, the word ‘document’ means anything
in which information of any description is recorded.
Response: The investigation is ongoing. The investigation may or may not
give rise to the need for formal enforcement under the planning acts. On
that basis, correspondence between the LPA and developers is considered to
be exempt from disclosure at this time under exception 12(5) (b) of the
Environmental Information regulations because its disclosure would
adversely affect—
(b)the course of justice, the ability of a person to receive a fair trial
or the ability of a public authority to conduct an inquiry of a criminal
or disciplinary nature;”
Disclosure of information concerning a current and live investigation
prior to its conclusion will jeopardise the investigation and there is a
substantial public interest in allowing investigations to proceed to their
conclusion via the normal investigation process.
I have considered whether the public interest test justifies overriding
the withholding of the information in this case but in view of the live
nature of the Councils investigation and its likely determination shortly,
do not believe that disclosure at this time and before the Council has
concluded its investigation and the role of any such action in remedying
the matter overrides the interests above.
Redactions are applied in line with our obligations as regards exception
13(1) – personal data of third parties.
The Flood Risk Assessment and Site Wide Plan will be sent in 2 separate
emails due to their size.

I am writing to request an internal review of South Cambridgeshire District Council's handling of my FOI request 'Northstowe Phase 1 and Phase 2 surface water drainage systems'.
The request concerned Northstowe Phase 1 and Phase 2. The council’s response only makes reference to Phase 1.
1. Can the council please explain what searches have been carried out to check that no further information was held within the scope of the request and why would these searches have been likely to retrieve any relevant information?
2. Please describe thoroughly any searches of relevant paper/electronic records and include details of any staff consultations.
3. Did the council perform any searches of emails sent by or sent to the responsible planning officer, Andrew Thompson?
4. If searches included electronic data, which search terms were used and please explain whether the search included information held locally on personal computers used by key officials (including laptop computers and personal devices) and on networked resources and emails.
5. If recorded information was held but is no longer held, when did the council cease to retain this information?
6. Does the council have a formal records management policy? If so, what does the policy say about the retention and deletion of records of this type?
The information provided in the form of the Northstowe Phase 1 Environmental Statement Technical Appendix H: Flood Risk Assessment was already required to be accessible to the public under other legislation.
