I am writing to request an internal review of Northamptonshire Police's handling of my FOI request 'Northamptonshire Police 2022 Police Vehicle Fleet List'.

You said that you couldn't release any details related to registration plate due to Section 31(1)(a)(b) - Law Enforcement, Section 31 is a qualified prejudice-based exemption and is subject to a public interest test. However, you didn't add in any armed response vehicles to the fleet list. You said that couldn't release any registration number plates. Not ARVs. Besides, you did release information related to ARVs for Dilip Patel FOI 496 18 request. I want you to take a look at this internal review and give me the information of ARVs based on the details that I listed without revealing any of the registration plates.

I have been asked to review the previous decision regarding your Freedom
of Information request dated 29/12/2022 and the reply you received on
27/01/2023. On behalf of Northamptonshire Police, I would like to
apologise for the delay in getting this information to you.
Northamptonshire Police provide an internal review process as per guidance
provided by the Information Commissioners Office. It is advised that where
an internal review process is available it is because the requestor is
unhappy with how the request has been handled or they do not think the
decision is correct.
I have considered the request you have made and consider that the response
that has been given is in accordance with the Act however in relation to
ARVs it requires further articulation under the same exemption. Under the
Act, we cannot, and do not request the motives of any applicant for
information. We have no doubt the vast majority of applications under the
Act are legitimate and do not have any ulterior motives, however, in
disclosing information to one applicant we are expressing a willingness to
provide it to anyone in the world. This means that a disclosure to a
genuinely interested applicant automatically opens it up for a similar
disclosure to anyone, including those who might represent a threat to
individuals.
S31(1)(a)(b) – Law Enforcement
Section 31 is a prejudice-based qualified exemption and there is a
requirement to articulate the harm as well as carrying out a public
interest test.
Evidence of Harm
As you may be aware, disclosure under FOIA is a release to the public at
large. Whilst not questioning the motives of the applicant, releasing any
information held regarding covert/specialist vehicles could pose a
significant risk to present and future law enforcement capability,
potentially placing both members of the public and the occupants of the
vehicles at risk. Policing would be undermined as offenders would gain
knowledge about these specialist vehicles and, therefore, would use this
knowledge to avoid detection. This would have a detrimental impact on
policing and a failure in providing care to both members of staff and the
public at large. Disclosing this information would lead to policing being
undermined as it would be used by those wishing to cause disruption or
harm to the communities we serve.
Factors favouring disclosure under Section 31
Releasing information held relating to these vehicles would give the
public confidence that public money was being spent on the most
appropriate type of vehicles.
Factors against disclosure under Section 31
Releasing information held relating to these vehicles would enable
criminals to know the capability of these vehicles which would jeopardise
the ability of the police to carry out their duty. Disclosure would
undermine policing and have a negative effect on the prevention and
detection of crime and the apprehension and prosecution of offenders.
It is widely known that police forces use covert/sensitive vehicles as
part of their delivery of effective operational law enforcement, however,
to reveal the number and details of these vehicles would reveal tactical
resources available to the force and would undermine ongoing covert
investigations. If this request was submitted nationally and the
information disclosed this awareness would provide a geographical picture
of the tactical covert vehicle strength of each individual force from a
covert perspective.
Whilst there is a call for transparency of policing operations and
investigations, the safety of the officers using these vehicles must also
be considered and undoubtedly disclosure would compromise their personal
safety. The same applies to armed response and sensitive vehicles. To
provide specific vehicle details would have a detrimental effect on the
force’s ability to deal with detection and prevention of crime.
Balance test
The police service is tasked with protecting the community and solving
crime and should not disclose information that would jeopardise this. By
disclosing the requested information would mean that criminal
investigations would be less effective and the small increase in public
awareness would not be adequate compensation for such an impact. I have,
therefore, decided that this information will not be provided. Pursuant to
Section 17(1) of the Act this letter acts as a Refusal Notice in response
to some of your request.
Please also note that information we provide and/or publish changes over
time due to various reasons and so comparisons should not be made between
current information and that made available several years ago.
After lodging an appeal with the Northamptonshire Police, if you are still
dissatisfied with the decision, you may make an application to the
Information Commissioner for a decision on whether the request for
information has been dealt with in accordance with the requirements of the
Act.
