Dear CCBC, your response is entirely misleading as the CPR you quote gives no information regarding the examination of evidence or of a judicial function.

Therefore your refusal is invalid.

Dear Her Majesty’s Courts and the Tribunals Service,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Her Majesty’s Courts and the Tribunals Service's handling of my FOI request 'Northampton Bulk Centre'.

The Northampton Bulk Centre does not have any staff of sufficient intellect yo process a simple freedom of information request. It is also incapable of providing a telephone number that actually gets answered.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/n...

Yours faithfully,

Pat James

Background - Why do we do Internal Reviews?
Under the Section 45 Code of Practice, public authorities are obliged to
provide a complaints procedure for FOI requests. As requesters
ultimately have a right of appeal to the Information Commissioner and
the Information Tribunal, internal reviews are a key opportunity to
ensure that our initial approach was correct.

It takes time to conduct an internal review, but it takes even longer to
manage an investigation by the ICO or defend a Tribunal case - so it’s
important we get them right.

Process - what do I need to do now?
All IR cases are Trigger cases, As your dedicated Disclosure Specialist
I will provide you with the guidance you need and will clear your
response before it is issued. The key dates are above.

You should now begin to gather the original request, audit trail and
information in-scope of the request

You will find a template IR response on the Intranet, which includes a
checklist to help you carry out the review.

Acknowledgment of request
[1]Acknowledge the request using templates and [2]guidance. Please bcc
me into the acknowledgement e-mail.

By Day 10

A draft must be sent to me by day 10.

Once you send me a draft, I will ensure compliance with the FOI Act and
clear in DACU. Draft responses should be cleared in your business unit,
at a senior level.

You should then issue the response to the requester, bcc-ing me. I will
then close the case down on our system. If you do not bcc me into the
final response the case will remain open, and show as an ‘out of time’
case on your statistics.

Dear Data Access & Compliance Unit, in response to your response of 3rd April requesting clarification of ‘parking charge notice’. This is a term in common usage by the legal system of this country and HMCTS, and if you do not comprehend its meaning you have no business being associated with the law or its administration.
Furthermore, you have indulged in obfuscation at every turn in order to avoid an honest answer to a valid request.

Yours sincerely,

Kyle Stubbs left an annotation ()

I find this so funny, it is literally people like him that give genuine users of the FOI act a bad name. The phrase: ‘we have courts of law (common law) and not courts of legislation’ literally show how feeble minded this guy is.
For those of you that don’t know, the common law is the unwritten rules that generally underpin the workings of the legal system, for example murder is a common law offence as it has never been enshrined in legislation; this, in turn, allows courts to build on and improve the law without the need for a new act of Parliament. Case law is also part of the common law.
Legislation is acts passed by parliament which dictate laws. In a ‘court of law’ the court can apply the common law, legislation, or both as it sees fit. To create a distinction between the two is ridiculous
