Dear Wendy Hall,

On 2nd October 2015 you stated, "We have a shared service with North East Lincolnshire Council..." pertaining to your organisation's Debt Management Section.

In light of this, on 5th October 2015 I made the following request, "Please provide a complete copy of the agreement between North Lincolnshire Council and North East Lincolnshire Council regarding the shared service."

On 5th November 2015 you then stated, "... we are dealing with your request but need a little extra time to finish considering whether to exempt the information and consider the public interest test."

Therefore it is quite clear, and you are aware of, which particular information I am requesting from your organisation.

It is now my belief that your latest response is designed to cause further and unnecessary delay and is also vexatious in nature since it is now causing me an unjustified level of disruption and irritation.

In view of your organisation's failure to follow the relevant requirements of the Freedom of Information Act 2000, I will now submit a complaint to the Information Commissioner.

Yours sincerely,

Alan

Perhaps North Lincolnshire Council, as a consequence of the shared service agreement, has to adopt the same level of intransigence. Something to do with the closer relationship it now has with North East Lincolnshire Council?

Stan Higgleston (Account suspended) left an annotation ()

There is some information in this publication about the shared service.

https://www.nelincs.gov.uk/GetAsset.aspx...

Page 5 of the News letter for example.

"As a shared service, North and North East Lincolnshire Councils have now completed a joint procurement exercise for Bailiff Services. Both authorities will be using the services of Rossendales and Newlyn for the recovery of Council Tax, Business Rates and Housing Benefit Overpayments. We are working closely with both providers to ensure that they operate to the appropriate standards and adhere to policies around vulnerability......"

Dear Wendy Hall,

Section 1 of the Freedom of Information Act 2000 (FOIA) provides two specific but related rights of access to information that require similar duties on public authorities. They are:

• the duty to inform the applicant whether or not information is held by the authority, and, if so,
• the duty to communicate that information to the applicant.

The FOIA refers to the first duty as, “the duty to confirm or deny”. Whereas the second duty is the one with which most requesters are concerned about, both duties however have equal weight.

In response to my request for an internal review, on 5th November 2015 you stated, "... we are dealing with your request but need a little extra time to finish considering whether to exempt the information and consider the public interest test." Obviously, any requester would also deem your response as confirmation that the requested information, i.e the shared service agreement, is indeed held by your organisation since it can be deduced from your response that it was identified, located and then in the process of been contemplated for disclosure by your organisation.

In light of your last message, it appears North Lincolnshire Council are now claiming they do not hold or alternatively, no longer wish to disclose, the requested information. Consequently, I believe this is further confirmation of your organisation's action to vex the requester and failure to follow the relevant requirements of the Freedom of Information Act 2000.

Yours sincerely,

Alan

Dear Wendy Hall,

Thank you for your response.

Your organisation must consider all the information that falls within the scope of the request. Therefore, your organisation considers the information they speak of is relevant to the request, in that they are agreements in respect of the shared service with North East Lincolnshire Council, and have a duty to confirm and disclose this information.

Your earlier consideration of the public interest test and request for more time is confirmation that a qualified exemption was engaged by your organisation in relation to all of the information you speak of and therefore it all falls within the scope of the request.

I would like to offer you a final opportunity in providing complete copies of the information. If I do not receive it within two working days, beginning 20th November 2015, then I will continue to submit a complaint to the Information Commissioner.

Yours sincerely,

Alan
