Dear PPD - FOI,

You have stated that the £1.23m figure quoted was not provided by the Council, rather by the RAC and so cannot provide a calculation.

I hate to ask the obvious, but how did the RAC calculate the sum, did it make it up? It's unlikely the motoring organisation would have obtained it from Freedom of Information with NELC's track record.

Yours sincerely,

Stan Higgleston

Dear North East Lincolnshire Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of North East Lincolnshire Council's handling of my FOI request 'North East Lincs Council makes £1.23m excess in parking charges for 2012-13'.

I don't believe the RAC would produce a calculation (a made-up calculation) that is in effect evidence that North East Lincolnshire Council is unlawfully profiting from parking charges. This I believe would leave them open to legal challenge and so the council will hold the information.

I ask therefore that the response is reviewed, and if the council maintain it does not hold the information, it denies that it made £1.23m excess in parking charges for 2012-13.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/n...

Yours faithfully,

Stan Higgleston

PPD - FOI, North East Lincolnshire Council

Dear Mr Higgleston

Thank you for your further correspondence in relation to information
request 6507_1314.

I have reviewed your request and determine that North East Lincolnshire
Council does not hold the information to answer your request: I'm made to
believe that it was revealed either on local radio or TV news on 23
December 2013, that North East Lincolnshire Council made £1.23million
profit from parking charges, fines etc. in 2012-13. Please supply the
calculation to support the above figure.

To assist with the understanding of why North East Lincolnshire Council
does not hold the information to answer your request we would direct you
to information provided to you in our response for freedom of Information
request 6629_1314. ‘The figures provided by the RAC relate to surplus
before capital charges are applied and do not match with our figures for
surplus.’

I trust that this answers your queries in relation to your request, and
clarifies that your request has been handled in accordance with the
Freedom of Information Act.

If you remain dissatisfied with the Council’s handling of your request, or
the decision of the internal review you can request an independent review
by contacting the Information Commissioner's Office at Wycliffe House,
Water Lane, Wilmslow, Cheshire SK9 5AF.
