Freedom of Information request – ICM6746

 

I refer to your request for information received by Norfolk County Council
dated 20 October 2015 which has been processed in accordance with the
Freedom of Information Act 2000 (the Act) and am now able to supply you
with the following response:

 

Your request:

 

How many Chief Executive Officers are not of the Jewish faith (list
faiths) and how many are also Jews? Please provide all recorded
information both past and present.

 

Our response:

 

We confirm we hold information however your request has been considered
and is refused. In accordance with the Freedom of Information Act 2000
this letter acts as a Refusal Notice.

 

Exemption Applied

 

Section 40(2) of the Act provides that any information to which a request
for information relates is exempt information if-

 

a       it constitutes personal data [about a third party], and

b       either the first or the second condition is satisfied.

 

In this case the first condition applies which is:

 

a       in a case where the information falls within the definition of
‘data’ under the Data Protection Act 1998, the disclosure of the
information would contravene

 

i.        any of the data protection principles or

ii.      Section 10 of the DPA (right to prevent processing likely to
cause damage or distress), and

 

b    In any other case, the disclosure of the information would contravene
any of the data protection principles if the exemptions in S33A(1) of DPA
were disregarded.

 

Reason why the exemption applies

 

This decision is based upon the following reasons:

 

Norfolk County Council has considered the nature of your request in line
with the Data Protection Act 1998.  The information you have requested is
considered personal data under the Data Protection Act. 

 

We have considered whether releasing this information would contravene any
of the Data Protection principles and have concluded that its release
would not be fair under Principle 1 of the Data Protection Act. 

 

Please note that if you are dissatisfied with our handling of your request
you do have the right of appeal through the County Council's internal
complaints procedure by setting out the grounds of your appeal in writing

Part I of the Act.
