Your request will now be considered in accordance with the Freedom of
Information Act 2000 (the Act). You should expect to receive a response
within the statutory timescale of 20 working days as defined by the Act,
subject to the information not being exempt or containing a reference to a
third party. In some circumstances Derbyshire Constabulary may be unable
to achieve this deadline. If this is likely you will be informed and given
a revised timescale at the earliest opportunity.

 

There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make payment then your request will remain
unanswered.

 

Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.

Thank you for your recent FOI request which is receiving attention.

 

However in order to enable me to respond accordingly could I please seek
clarification as to what time period you mean when you refer to ‘last
year’.  For example is it the 2012 calendar year or the 2012/13 financial
year.  As you will appreciate both may throw up different answers.

 

I also have to add that pending receipt of this clarification I have
placed your request on hold.  Additionally if I have not received this
clarification within 20 working days I will close the request down on the
basis that the information is no longer required.

Dear Derbyshire Constabulary,

I am writing to request an internal review of Derbyshire Constabulary's handling of my FOI request 'Non Emergency Vehicles Exempt from Speeding'.

I do not accept the reasons you have given for rejecting the request.

Adopting a pseudonym to run a humour website critical of the police was a necessary step to protect myself from their inevitable persecution. A fact that you would be aware of having read the 'About Me' page at www.crimebodge.com. The humorous comment that you quote from my website - which is entirely separate from my FOI request - is clear indication that the name 'Talbot Munce' is a pseudonym. Using a pseudonym to make FOI requests is perfectly lawful and the fact that we are corresponding as such is further proof that I am 'a real person'.

Furthermore, you have satisfied a number of earlier FOI requests I made under the same name without prior research or objection. I provide the URL http://crimebodge.com as a backup correspondence address, if for any reason the primary 'Whatdotheyknow' URL address should fail and should not be considered as part of my FOI request.

Your refusal to comply is more likely due to a clear disdain for the contents of www.crimbeodge.com. Reinterpreting ICO guidelines as an attempt to retaliate is an abuse of both your position and the law.

As previously stated Section 8 (1)(b) of the Freedom of Information Act 2000 requires the name (real name) of an applicant in order for the request to be deemed as valid. This is a position backed by the Information Commissioner and the link I provided in my initial response will take you to the specific guidance.

Forgive me for not having read your web site in any great detail previously but having done so recently I am now satisfied that Talbot Munce, for whatever reason, is not a real name; a fact you have reconfirmed below.

Given that the request is not valid under law it does not fall within the scope of the Act. As such I will not be arranging an internal review. However, if you supply proof of identity as requested I will be happy to review my decision.
