Non disclosure agreements

We're waiting for FOI.Wales to read recent responses and update the status.

Dear FOI Team,

I'm writing to request the following information under the Freedom of Information (FOI) Act:

How much has the local authority spent on settling non-disclosure agreements (NDAs) with staff who leave the authority's employment during each of the last three financial years?

The total number of staff who received such payments in each of those years.

Details of the largest single payment in each of those years.

Thank you for your recent request for information held by Denbighshire
County Council received 20/05/2024 regarding non-disclosure agreements.

As set out by the Freedom of Information Act 2000 it will be our aim to
respond to your request by 18/06/2024. In some cases, however, we may be
unable to achieve this deadline. If this occurs, we will advise you of the
likely timescale within which the response will be provided.

Under the Freedom of Information Act the Council may charge for
disbursement costs (e.g. photocopies, postage). However, should there be
any such costs, you will be notified of this prior to the commencement of
any work.

20/05/2024 concerning Non-Disclosure Agreements. Please see below:

2021/22 Staff – less than 5 - Total cost £78,163

As the number of NDAs in 2021/22 was less than five the identification of
the recipient of the NDA and the amount they were given would be possible,
especially when combined with other information that may be in the public
domain. The exact number is therefore exempt under Section 40 (2) of the
Freedom of Information Act 2000 (third party personal data). We are
obliged to process the personal data that we hold fairly and lawfully
under the Data Protection Act 2018/ GDPR.

2022/23 Staff - 7  -Total cost £50,248

2023/24 Staff – 7 - Total cost £109.625

The  largest amount for all three years is also exempt under Section 40
(2) of the Freedom of Information Act 2000 (third party personal data).
Individuals could be identified from the 7s or less than 5 and the amount
they were given surmised, especially when combined with other
known information.  We are obliged to process the personal data that we
hold fairly and lawfully under the Data Protection Act 2018/ GDPR.
