Dear Gambling Commission,

Please can you inform me of the number of Non-Disclosure Agreements (NDA) issued by betting/gambling companies - between January 2018 and April 2019 - to settle disputes with their customers?

Are betting companies - such as Betfred - allowed to use NDAs under the terms of the licence the Gambling Commission grants them to operate?

Is Betfred, which is registered in Gibraltar, exempt from complying with Consumer Rights Law in Britain?

Dear Mr Cairns

Thank you for your request which has been processed under the Freedom of information Act 2000 (FOIA).

In relation to the first part of your request in which you have asked:

‘the number of Non-Disclosure Agreements (NDA) issued by betting/gambling companies - between January 2018 and April 2019 - to settle disputes with their customers?’

We do not hold figures for the amount of NDAs issued by all betting/gambling companies to settle disputes with their customers. Though we may seek information on NDAs on a case by case basis from operators, we do not hold industry statistics on all NDAs issued.

Regarding the second and third parts of your request where you have asked:

‘Are betting companies - such as Betfred - allowed to use NDAs under the terms of the licence the Gambling Commission grants them to operate?
Is Betfred, which is registered in Gibraltar, exempt from complying with Consumer Rights Law in Britain?’

It should be noted that requests made under the FOIA can only be used to ask us to supply documents and records that we hold. It cannot be used to ask us for our views or opinions on matters that are not explicitly documented or recorded. We will sometimes provide our views where we can, in order to try and help answer a question. Therefore, we direct you to the warning issued to the industry on the use of NDAs by the Commission; which clearly lays out the Commission's position on the use of NDAs and the relevance of licence conditions.
