Non-crime hate speech - language used to record/notifying individuals/annual figures

Dear Gloucestershire Constabulary,

Miller v The College of Policing [2021] EWCA Civ 1926

"117. ...The net for non-crime hate speech is an exceptionally wide one ...There is no provision for proportionality to be applied to recording. And the Guidance says nothing about the language to be used in any such record, or whether someone should be notified that a record, flagged as a hate incident has been made of a complaint against them, leaving such issues to individual forces to decide."

1. Please provide full details of the language you chose to record non-crime hate incidents for 2019/20 eg information telling officers how to respond to non-crime hate incidents and how to input details on your computer system.

2. Please provide screenshots of the relevant screens used to record non-crime hate incidents. Where a screen includes drop-down menus, please include full details of all menus.

3. Please provide full details of your policy on notifying individuals who had complaints made against them in 2019/20 that were flagged as non-crime hate incidents.

4. Please provide the number of non-crime hate incidents you recorded in 2019/20, 2020/21 and 2021/22.

5. Of the non-crime hate incidents you recorded in January, February and March 2020, please specify how many of the individuals concerned were notified of their involvement in these incidents.
