Nominating a lead carer (responsible carer) in a UC claim when one parent is in receipt of carers allowance
Dear Department for Work and Pensions,
Please can you confirm if there are any restrictions on nominating lead carer (referred to as responsible carer in ADM) in a Universal Credit claim involving a child.
Specifically I would like to ask if one parent is in receipt of carers allowance for their child on the claim then do they become the lead/responsible carer by default or can the other parent be nominated?
For example if mother is in receipt of carers allowance for her daughter then could the other parent be named as responsible carer to same child and be exempt to the expected number of hours of work rule.
This could then mean the other parent may have reduced work search commitments around the care of the child while the mother is exempt as she is in receipt of carers allowance?
I hope I have explained this well enough and if my scenario is not possible could you please refer me to the legislation or ADM guidance which addresses this.
