I note from Sir Alex Allans recent Review report onto ex.Deputy PHSO Mick Martin that:

'The Ombudsman told me that, as a measure to ensure the continuing good standing of senior PHSO staff, she had now decided that they would be asked to provide information and certify that they were meeting the Nolan Principles of Public Life each year. Any breach of those principles would be dealt with under PH50's disciplinary procedures.

Please advisde: as PHSO had 'now decided' what has been in place to ensure fairness by Senior PHSO staff up until 'Now'. As the Nolan Principles have been in place since 1995 (21 years)How have the Nolan Principles of
Selflessness
Integrity
Objectivity
Accountability
Openness
Honesty
Leadership been met?
I understand the PHSO Principles have been adopted by many too and I assume there are examples of this work?

Your information request (FDN-270643)

 

I am writing in response to your email of 23 September in which you asked
how PHSO has met the seven principles of public life, otherwise known as
the Nolan principles, since 1995.  You also state ‘I understand the PHSO
Principles have been adopted by many too and I assume there are examples
of this work?’

 

Your request as currently framed is too broad for us to respond to.  As
you may be aware, section 12 of the Freedom of Information Act 2000 (FOIA)
is an exemption which states that public authorities are not obliged to
respond to information requests where it would exceed the appropriate
limit to extract all relevant information.  In this case, that limit is 18
hours or £450.  As your question is very broad, and covers such a wide
time frame, we are unable to respond to it within the appropriate limit
and, as such, section 12 FOIA applies to it.  The Information
Commissioner’s Office (ICO) website contains some useful advice on how to

Since Dame Julie Mellor received the letter and Tribunal verdict from Helen Marks and apparently ignored both for 8 months -until publically outed by the HSJournal- that exactly doesn't conform to the Nolan principles. Neither does it explain why former Equalities Head Dame Julie missed the fact that a female had been eased out of her job - after refusing the advances of a male chairman.

Seemingly she then read the read the principles and decided that the PHSO employees were subject to them, during being investigated by Sir Alex Allen, who then produced such a critical report.

Some complainants have stated their opinion that the Ombudsman has never considered itself to be hampered by these inconvenient principles.

The reason the Nolan Principals are not followed in the PHSO is that they are unaccountable so they don't have to....simple.
