Noise Complaints

I am 100% sure that the councils response is not true (none of the complaints that the residents made are showing anywhere on the councils list), as in 2021 many residents in the vicinity of the rubbish dump and the concrete company at 250 Toddington Road Luton made well over 1,000 complaints in 2021 (including over 1,000 noise recordings being sent to them by residents via the Noise App, which the council falsely tried to claim had been faked when they were 100% factual which they refused to even come out to take their own evidence of) about noise nuisances, which are to this day constantly 70db-120db when the legal BS4142 noise limit is 30db (as well as complaints about extremely bad dust pollution and floor vibrations and breaches of working hours), all being done outside, including noise from high pitched screeching from grinding metal with more than 10 different grinders, banging metal with hammers, clanking metal poles (all three coming from manufacturing of metal fences with no planning permission), 120db Stihl cutters fettling concrete with no planning permission causing floor vibrations and dangerous dust pollution, nonstop high pitched humming noise from 3 crushing/shredding machines shredding rubbish into dust making the floor vibration and causing dangerous dust pollution (being used without planning permission), high pitched reverse beeping and clanking/banging/thudding from numerous illegal diggers including the bucket heads being dragged across the floor making floor vibrations and causing dust pollution moving rubbish, high pitched beeping and clanking from forklifts, high pitched beeping and clanking of 200-300 illegal skip lorrys movements per day (only 4 skip lorrys are allowed and only 40 skip lorrys movements are allowed per day), concrete stair lorrys high pitched beeping/banging, Kango hammers breaking up concrete with no planning permission, generators running, music blaring out, shouting/swearing, etc., all starting from illegal hours of 3.00am/4.45am to past 7.00pm/9.00pm Monday to Saturday and noise on Sundays and Bank Holidays and also through the night when the permitted hours are Monday to Friday 8.00am to 6.00pm, Saturdays 8.00am to 1.00pm and no working on Sundays or Bank Holidays. Despite the council confirming in 2014 and in three planning applications that the high pitched beeping, grinding and banging with hammers are persistent invasive statutory noise nuisances (that since then has moved from the back to the front of the premises, even nearer to our homes) which has continued to increase by 100% per year, to the point where it is now like living on a permanent construction site, in 2021 (and also 2022 and 2023 when even more complaints have been made) the council has never responded or been out to witness one single complaint and all of the statutory noise nuisances are still ongoing to this day. The noise nuisances (that we can hear indoors with the windows and doors closed) and dust pollution from these premises has now become so bad that we can't have the windows open and can't sit outside in our gardens and if we go outside we have to wear ear defenders (we can still hear the noise even when wearing them) and have to wear a dust mask (we can smell and taste the dust even through a dust mask). Despite the residents sending the council thousands of videos/noise recordings and photos proving that the noise nuisances are persistently 70db-100db and proving the dust pollution from the illegal grinding and the huge clouds of continuous dust from the crushing/shredding machines that goes on for 13-16 hours nonstop, the council have refused to come out to take evidence of it and have refused to do a noise investigation of each noise nuisance in compliance to the BS4142 law (the council also refused to do a BS4142 law noise investigation for a planning application for retrospective works in 2021 despite the government web site stating that this must be done and if noise complaints are likely the application should be refused, but the application was approved without any noise investigations taking place in the councils full knowledge that noises on these premises are serious noise nuisances to the residents in clear breach of the Environmental Protection Act law and in clear breach of the Human Rights Act law "Right to a peaceful use of our home and garden"), leaving the local residents lives a living hell.
