Noise complaint policy and the Environmental Protection Act

Dear Telford and Wrekin Council,

Further to a recent FOI request, with reference TWC-43871, I wish to make a follow-up FOI request. Point 3 of the response I received stated that the complaint will only be logged if a full address is provided for the noise location. What information has Telford & Wrekin Council (T&W) got about the legislative compliance of requiring a full address for a noise location? This may be legal opinion about the council noise complaint logging policy or notes, emails, etc... discussing the legislative compliance of the policy.

As background to my request the Environmental Protection Act, the legislation that supports noise complaints, does not specify that a full address has to be provided. I am interested in how T&W have interpreted the legislation and come to the conclusion that they may exclude complaints that are being made within the Act.

Thank you for your request for information received by us on 09 November
2016 asking for the following:

As background to my request the Environmental Protection Act, the
legislation that supports noise complaints, does not specify that a full
address has to be provided. I am interested in how T&W have interpreted

complaints that are being made within the Act.

 

The Freedom of Information Act requires us to provide this information to
you within 20 working days of receiving your request. Therefore we will
aim to respond to you by the 07 December 2016

However, if the information you request is subject to an exemption which
prevents us from releasing it, as defined by the Act, we will issue you
with a Refusal Notice together with your rights of appeal.  

There are circumstances where a fee may be payable by you to cover
administration costs (e.g. printing, copying, postage and packaging). If
this applies to your request we will issue you with a ‘Fees Notice’
requesting payment. The fee must be paid before the information requested
is processed and released. The 20 working day time limit for responding
to your request will be suspended until payment is received.

In the meantime, if you have any queries please do not hesitate to contact
us, quoting the above reference number.
