No Loss of curriculum at CAMSFC if land is sold to a supermarket

Has YPLA received any detailed plans from CAMSFC or their advisers for Buxton Land campus that will meet the curriculum need currently provided by both Hibbert Lane and Buxton Lane campuses, and that satisfies the YPLA that provision of all subjects can be provided.
There are concerns amongst students and parents that this may not be the case

I am replying to your Freedom of Information request below.

 

The YPLA has not received any detailed plans from Cheadle and Maple
College regarding their arrangements for delivery of the College’s
curriculum at the Buxton Lane Campus. However the College has confirmed
that there is no intention to reduce the curriculum offer in Marple and
that their architects are generating plans that will allow all the
curriculum areas currently delivered in Marple to be included on the
Buxton Lane site. They have also stated that the rationale underpinning
the sale of Hibbert Lane is to generate capital to then enhance the Buxton
Lane site in Marple so that the College can continue to offer the current
curriculum offer in vastly improved buildings.

 

You may be aware of the statement on the College’s website
([1]http://www.camsfc.ac.uk/cmsfc-about.asp?...  ) about their plans
for the redevelopment of the Buxton Lane site, and that as soon as they
are at a stage where these can be shared with the local authority and the
local community, the full consultation programme will commence.

 

In order to inform our consent to the sale of the Hibbert Lane site and as
required by the Financial Memorandum between the YPLA and colleges

the LSC Capital Handbook

we requested and received, assurance and evidence that the Governing Body
had considered the educational justification for selling Hibbert Lane
including plans for developing Buxton Lane and for provision in Marple in
general.

 

The YPLA has now given consent to the College to enter into a conditional
contract to sell the Hibbert Lane site. This consent is conditional on
planning permission being secured on the Hibbert Lane site as well as
planning permission being secured for a new build development on the
College’s Buxton Lane site in order to accommodate the provision that
currently takes place at the Hibbert Lane site.

Our interpretation of your original Freedom of Information Request dated
13^th November and received on the 14^th November was for ‘any detailed
plans from CAMSFC or their advisers  for Buxton Land campus that will meet
the curriculum need currently provided by both Hibbert Lane and Buxton
Lane campuses, and that  satisfies the YPLA that provision of all subjects
can be provided’. 

 

Our response was that we do not hold this information as no such plans
were provided but thought it would be helpful to explain the basis under
which the YPLA had provided consent.

 

We received your email below on the 6^th December which stated that you
require copies of any documentation, plans or contracts in relation to
this issue.  We are now treating this as a new Freedom of Information
request for copies of any relevant documents.  We are searching for any
information we may hold and will respond as quickly as possible.

I want this to be conducted under an FOI and no my concerns have not been
addressed

But just to remind the YPLA  once you have agreed the sale of the land and
the campus is lost because the bull dozers have moved in what is the YPLA
going to do if all the facilities do not fit on to the Buxton Lane site
?   Because I hope the YPLA do not think that some of the  curriculum can
be delivered at  the Cheadle campus because if you do that's twisting your
own  procedures

I would like the YPLA to answer via a FOI as there are quite a few
interested parties following this topic.  So once again via a FOI please
provide details of documentation, plans or contracts which will assure no
loss of curriculum or facilities at CAMSFC MARPLE

Thank you for your email of 15 December 2011 regarding Cheadle and Marple
Sixth Form College. I am assuming that in your message ‘SMBC’ refers to
Stockport Metropolitan Borough Council.  If that is the case, I can
confirm that local authorities are not required to give consent to sixth
form colleges for them to dispose of their assets.

This maybe the case on other sales of sitxth form colleges but sports facilities and the youth club are in the deeds as still being owned and controlled by the council for the people of MARPLE who do not want them relocating
This is an issue that the YPLA need to look closely into as the community will not agree to the the on Hibbert Lane campus

Thank you for your email which I understand refers to your email of the
4^th January  which I have reproduced below.

 

Please can you send hard  copies I have an iPad which I fear is not
allowing me to open them  can you also send the original deeds with the
original covenants on which I hope you have had sight off before agreeing
the sale of the land.  The people of MARPLE still have sports facilities
and a youth club on that site which Miss Cassidy has always tried to stop
local people using.  The people of MARPLE will not agree to the loss of
 facilities on that site or indeed agree to the relocation down to Buxton
Lane so I hope the YPLA fully understands this.

My response of the 6^th January which I have reproduced below addressed
the information you requested which is our obligation under the Freedom of
Information Act.  There was no specific request for information about the
sports facilities and youth club, rather it was a comment for which we
have no information to be able respond to you about.   It is possible the
deeds or covenants may address the point you raised but as explained in my
email below, the YPLA do not hold these documents.

I have today posted a copy of the response to your request.  With regard
to your request for deeds and covenants, the YPLA does not hold copies of
the deeds and covenants associated with Cheadle and Marple Sixth Form
College. As you will be aware, sixth form colleges are independent
corporations and they should take their own professional advice on these
matters when considering the disposal of assets. You may wish to approach
the College directly to request copies of the relevant documents and you
could contact the local authority about the transfer of any covenanted
facilities and services to Buxton Lane.
