Please release advisory written (including emailed) communication between the GDC and GVA (your advisors on said property rental), pertaining to the market rental value of your Birmingham offices, and any reduction in said rental valuation negotiated for or by the GDC for their occupation (15 year lease) of the site.

Please state whether attempts were made to secure a below market rental agreement for your Birmingham offices.

Please state whether any rental or rates relief has been attained by the GDC, due to the COVID-19 crisis, for this office.

I am writing to request an internal review of General Dental Council's handling of my FOI request 'No.1 Colmore Square, Birmingham B4 6AJ.'.

I will address your reasons for rebuttal of a large portion of my FOI request below:

1 - Regarding your refusal to provide me with your actual annual rental value for your offices at No.1 Colmore Square, I would draw your attention to the following document - 'Moving Upstream' released by the GDC during January 2020. This formal position paper includes an introductory section authored by your Chair, Dr William Moyes. Within this introduction, he mentions your new operational hub in Birmingham, as aforementioned here, and he then extols this as part of a long-term programme to increase cost effectiveness. In the next paragraph, he confirms that your Wimpole Street London base, continues to benefit from a peppercorn rent.
A peppercorn rent can be legally defined as a nominal payment sufficient for the creation of a legal contract. in this case, between the GDC and Howard de Walden Estate.
In the case of Wimpole Street, the GDC uses the material fact of a continuing peppercorn rental arrangement to provide a positive public facing documentary position of improving cost efficiency. A formal officer of the GDC, Dr Moyes, confirms the nature of the financial expenditure on that rental arrangement, which is defined as nominal, and this is used to enhance the reputation of the GDC regarding financial rectitude.
Surely, it follows that the rental arrangement for your comparable site in Birmingham, No.1 Colmore Square, with your self professed disclosure that a discount has been achieved for that rental value, must be fully disclosed. A failure to do so, prevents your registrants, who provide you with your liquidity, indeed with all your finances, from performing due diligence on your financial outgoings here.
2 - Your Chair, Dr Moyes, has used the fact of a peppercorn rental arrangement in London, as a positive comment within a position statement, 'Moving Upstream'. It would show bias, for a perhaps, less financially advantageous rental arrangement in Birmingham, to be withheld. Bias of this nature, is unacceptable for a holder of senior accountability within the GDC.
3 - Regarding your argument that providing me with written details of the GDC/GVA negotiations with LGIM Real Assets, and your hypothetical future situation where landlords and suppliers might be less likely to negotiate with the GDC if the facts became public knowledge. This fails to take into account your absolute requirement to negotiate for best value with 'public' (rather, GDC registrant ARFs) monies, and thus show such fiscal rectitude via full disclosure.

I am afraid that your recalcitrance regarding full and complete disclosure of the above facts is completely unacceptable, provides scant succour for a disenfranchised profession and is not in the public interest.
