I am looking to obtain a report, in excel format, of any business rates accounts, closed or open, in the name of Henkel Limited or in the names of their subsidiary companies, for the period 1 April 2005 to present: -

Henkel UK Operations Limited
National Adhesives Holding Ltd
Schwarzkopf Limited
Akzo Nobel
Shiseido Group.

The report should include the following: -

1. Account Name
2. Address of the Property
3. BA Reference Number
4. Liability Start Date
5. Liability End Date (if a closed account)
6. If a credit is showing on the account:-
a) Amount of credit
b) Account Number the credit relates to
c) Period the credit relates to
d) Reason for the credit.

Henkel Limited and Subsidiary Companies – liabilities and credits

 

Thank you for your Freedom of Information request, which was logged under
FOI 19/96 and passed to me to respond accordingly.

 

Under Section 1 of the Freedom of Information Act 2000 (the 2000 Act) you
are entitled to be informed in writing whether the council holds the
information specified in your request and, if that is the case, to have
that information communicated to you unless any of the statutory
exemptions apply.  I have considered your request and can confirm that
although we do hold the information asked, I believe some of the
information requested (credits on accounts) to be exempt from the rights
of access under section 31(1)(a) of the Act.

 

Under Section 31(1)(a) the council is permitted to withhold information if
its disclosure would prejudice the prevention and detection of crime.  It
is the council's view that disclosing the requested information on
accounts in credit would or would be likely to prejudice the prevention of
crime in that releasing this information, would increase the likelihood of
credits being claimed fraudulently.

The exemption available under section 31(1)(a) is one of the exemptions
which is subject to the public interest test. Therefore even when, as
here, the council considers the exemption is engaged it must then go on to
consider whether the public interest in maintaining the exemption
outweighs the public interest in disclosing the information.

The council recognises that there is public interest in the release of
this information for transparency and accountability reasons. However, it
is not in the public interest to disclose information which could lead to
a criminal act. Furthermore, whenever an account falls into credit a
credit bill is automatically issued and a refund request form is also sent
so ratepayers can quickly claim their full refund. The council will
also provide to those agents acting on behalf of a ratepayer data
on credits and overpayments if the agents provide letters of authority.

You have expressed a requirement to have details of accounts held in the
name of Henkel Limited or their subsidiary companies. The council
publishes a list of liabilities to business rates (stripped of personal
information) on the business rates freedom of information page on its
websites below.   From this information the data you have requested can be
obtained.

Please treat this as the council's formal response under the 2000 Act. If
you are not satisfied with the decision I have made in response to your
request, you may complain under the council's complaints procedure. If you
remain dissatisfied after following that procedure, you have the right

Commissioner if you feel the council has not dealt with your request
