NJC & EMP circulars
Dear Local Government Association,
Under the f.o.i act can you supply me all the njc & emp fire circulars from 1998 to present. The reason for the request is your website requires a log in to view. I do not have a log in nor do I intend giving you my details other than as required under the f.o.i act.
Please supply all circulars in PDF format.

Thank you for the replies with the information. However the standard of the replies is disappointing. That being not all the circulars oriented the same way in the PDF files. Therefore either treat this as a request for an internal review to have the information supplied correctly and in a competent way or as a complaint against the person who collated it.

Please accept our apologies that all the PDFs are not in the same format.
As you're probably aware, we've spent a tremendous amount of time scanning
these in, in order to get them to you as quickly as possible. In this
case, the sheer volume of circulars has meant that some were scanned in
upside down. We will rescan these for you so that you can have the files
in the same orientation, and endeavour to do this as quickly as possible.

Thank you for your request for information made under the Freedom of
Information Act 2000 (FOIA) on 4 November, and for your subsequent request
to resubmit the circulars we had uploaded in the correct orientation. I am
pleased to attach the circulars here for you (due to the file size, I will
do this over a number of emails).
We have considered your request for all NJC and EMP Fire Circulars from
1998 to 2013, and we are partly complying with your request. There are 4
Employers circulars we are unable to release to you. The decision not to
release was taken with reference to the following exemptions under the
FOIA:
- Section 41 (Confidential Information) - We believe that the information
provided by legal advisers for this circular was provided in confidence,
and therefore falls within this exemption
- Section 42 (Legal Professional Privilege) - We believe that the
information provided by legal advisers for this circular was provided in
confidence, and therefore falls within this exemption
Section 41 is an absolute exemption, which means that if we consider that
the exemption applies, no further test need be applied, and the
information does not have to be disclosed.
Section 42 is a "qualified exemption", meaning that we have to consider
the public interest test before finally deciding whether the information
should be released. In this case, we consider that the public interest in
withholding the information outweighs the public interest in disclosing
the information. This is because the information is significant, and
sensitive in relation to ongoing discussions.
I'm sorry that we are unable to accommodate your request fully on this
occasion.
