Dear Chris Gooday,

Further to your reply I have found the OJEU references for the frameworks in question. They are as follows:

Endoscopy - Contract Award Notice 2008/S 234-310827

Theatres/ITU - Contract Award Notice 2009/S 81-116317

Sluice Rooms - Contract Award Notice 2009/S 112-160934

Sterilisation - Contract Award Notice 2009/S 129-187920

Pathology - Contract Award Notice 2009/S 131-190937

Cardio - Contract Award Notice 2009/S 129-187928

Radiotherapy - Contract Notice 2009/S 67-096875

Microscopes - Contract Award Notice 2009/S 227-325618

Calibration - Contract Award Notice 2009/S 174-250677

Opthalmology - Contract Award Notice 2009/S 228-327255

You also asked for clarification of the documentation I require. I require all of the documentation sent out with the original Invitation to Tender. I need the Framework Agreements to be the final versions if there were any changes made during the tendering process.

You ask about the time period to be covered. I don’t think this is relevant as the information pertains to a specific tender/framework agreements. However, could you let me know if all of the frameworks established in 2008 have been extended?

I trust this clarification will facilitate an early response. Pls confirm that this will be the case.

Yours sincerely,

Mike Smith

Dear Deborah Williams,

I made this request on April 26th. You then waited 10 days until 6th May to request a clarification.

You now say that you have received the request on May 12th and that I will not receive an answer until June 13th. I think that I should receive an earlier reply. Please clarify.

Yours sincerely,

Mike Smith

Dear Chris Gooday,

I can't read your message. It comes up with a .bin extension and I can't see any text.

Thanks

Chris Gooday,

Hi Mike,

The Information Commissioner has provided guidance on this at

http://www.ico.gov.uk/upload/documents/l...

I have reproduced below the most relevant parts of the guidance and
underlined key points. This shows how Section 1 (3) of the Freedom of
Information Act 2000 means that the clock was set to day zero when we
sent a letter to you requesting clarification. Day 1 then became the
working day after we received your clarification. This then resulted in
a revised working day 20 being detailed in our recent acknowledgement.

2. When does the 20 working day clock start?

The 20 working day clock starts. the day after the public authority
receives the request.
According to section 10(1) the time limit for compliance is the
twentieth working day following the date of receipt. or . the day the
authority receives further information it reasonably requires in order
to identify and locate the information requested; section 1(3).

Please refer to question 4 below, regarding the effect of section 1(3)
of the Act.

4. What if the authority is unable to find the information requested,
because the applicant has not provided enough details?
Under section 1(3) of the Act, "where a public authority -
(a) reasonably requires further information in order to identify and
locate the information requested, and
(b) has informed the applicant of that requirement" the authority is
not required to comply with the request until that further information
is provided. "

Whilst the applicant may have made an FOI request under the terms of
the Act, by describing the information he/she seeks, the 20 working day
time limit would not start until the authority had sufficient
information to enable it to deal with that request.

Example 1
Request:
Please send me all the information you hold about my ancestor John
Smith, who served in the British Army during the 19th Century.

Response:
The applicant has described the information he seeks, but the
description is not sufficient to enable the authority to identify and
locate the correct record. The authority informs the applicant that it
requires further information, under section 1(3), (for example, a
narrowing of dates, information about regiment or location) and the 20
working days does not start until the authority has been supplied with
that information.

I hope you find this helpful.

Regards
