Dear Portsmouth Hospitals University NHS Trust,

Under the provisions of the Freedom of Information Act 2000, I am writing to request the following information. This information relates to the NHS England Emergency Preparedness, Resilience and Response Framework in general and section 7, “NHS incident response levels”, in particular. I am requesting this information from the Trust rather than NHS England or the Integrated Care Board because I wish to know what information is held by the Trust.

For clarity I have enumerated the information I am requesting. If you do not hold some of this information then I ask you to confirm explicitly that you do not hold it.

I request:

1. Any record held of the number of days the Trust was at Level 1 incident response level between June 2023 and May 2024 inclusive.

2. Any record held of the number of days the Trust was at Level 2 incident response level between June 2023 and May 2024 inclusive.

3. Any record held of the number of days the Trust was at Level 3 incident response level between June 2023 and May 2024 inclusive.

Acknowledgement of Request for information under the Freedom of
Information Act 2000

Thank you for your request for information, made under the Freedom of
Information Act 2000 (the Act) which was received by Portsmouth Hospitals
University NHS Trust.

Under the terms of the Act the Trust expect to respond to your request
within 20 working days. However, the Trust will also investigate the
nature of the information requested. If clarification is required in order
to identify the information requested then the response period will be
suspended until such time as the FOI Team receive clarification.

Please note that in accordance with section 12(4) of the Act where

exemptions prior to releasing the information to you. The FOI Team will
advise you if we are unable to provide the information requested due to
exemption(s).

I am writing to request an internal review of Portsmouth Hospitals University NHS Trust's handling of my FOI request 'NHS Trust Incident Response Levels'. The Trust has not disclosed the information I requested. I requested:

1. Any record held of the number of days the Trust was at Level 1 incident response level between June 2023 and May 2024 inclusive.

2. Any record held of the number of days the Trust was at Level 2 incident response level between June 2023 and May 2024 inclusive.

3. Any record held of the number of days the Trust was at Level 3 incident response level between June 2023 and May 2024 inclusive.

The Trust has disclosed "there were a total of 90 instances of Level 3 within the specified time period. All other instances during this time period were classified as Level 4." A Level 4 incident response is a national response declared by NHS England. There was no such declaration during the specified time period.
