Dear Birmingham and Solihull Mental Health NHS Foundation Trust,

(1) Please can you give me levels of payout in BSMHFT negligent death of service users, by year, for up to 10 years past; or indicate where I can easily find the data?

(2) To help in your FOI obligation to questioner, and if the Trust feels there are different levels or degrees or circumstances of negligent death, please give Trust classifications and commensurate payouts for those?

-- Please give figures for longest period where data are available.

Birmingham and Solihull Mental Health NHS Foundation Trust does not make payouts in negligence cases. Such payments are made by NHS Resolution.

Not applicable, please see above response.

Please give figures for longest period where data are available.
To allow Trust response within cost please provide data for max yrs. within your capacity to comply.

End of response

Dear FOIOffice (BIRMINGHAM AND SOLIHULL MENTAL HEALTH NHS FOUNDATION TRUST),

Thank you for the information although I do not see why a NIL response should take One Month to respond. I am sure it is in Trust Policy however. Point noted for future questions.

Yours sincerely,

C Rock
